Dear Sirs,

Luton Borough Council is the surveying authority for applications to modify the definitive map and statement maintained by the Council under the Wildlife and Countryside Act 1981.

I asked for information about your definitive map on 29 Jul 17 and again on 29 Nov 17, but have not had a response. I now ask under FOI legislation in the hope that that will get me an answer.

Please would you advise the official title of your definitive map, so that I may quote it on a modification order application. It might still be Bedfordshire's from the original surveys, or you may have consolidated since becoming a unitary authority, so I cannot determine the title unless you tell me. If I get the application form wrong, it may be invalidated, so this is an important question.

I wrote to you last year (24 Dec 17) but have not yet received a substantive reply, althought your email system acknowledged receipt. Please could you answer my FOI/EIR request?

We refer to your email under FOI legislation requesting details of the official title of our Definitive Map, so that you may quote it on a modification order application.

Firstly, we apologise for the fact that you had previously requested this information about our Definitive Map on 29 July and again on 29 November 2017, but did not receive a response to either, although it is not clear from your email who your previous requests had been directed to. We also apologise for the delay in responding to your FOI request, but this has taken time to investigate given its specific nature about the official title of our Definitive Map.

We do hold this information. Luton Borough Council is the surveying authority for applications to modify the Definitive Map and Statement maintained by the Council under the Wildlife and Countryside Act 1981. The Council has recently published an electronic copy of the Definitive Map for Luton. We are not aware there have been any Consolidation Orders published to date since Luton became a unitary authority. However, whilst here have been surveys of Public Rights of Way in Luton as part of the production of our first and second Rights of Way Improvement Plans respectively in 2008 and 2016, the Definitive Map Statement was not updated at that time. A previous survey of Public Rights of Way in Luton undertaken by the Chilterns Initiative in 1998-99 appears to have been based on mapping information provided by Bedfordshire County Council.
Taking all of the above information into account, we can only assume that the title of the Definitive Map and Statement would be the same as that originally published by the "County of Bedfordshire in the District of Luton".
