Dear Mr Eastman

I write in response to your email dated 2^nd July 2019, requesting an
independent appeal against the decision made in relation to your request
for information under the Freedom of Information Act 2000.

Therefore In line with S45 of the Freedom of Information Act 2000 (Code of
Practice), I have conducted an internal review in relation to your request
for information. In carrying out this review, reference is made to the
legislation guidance, the Code of Practice on the Discharge of the
Functions of Public Authorities under Part 1 of the Freedom of Information
Act.

For the purposes of clarity, your original request of 23/04/2019

Can you please confirm the total number of offences (Exceed 30 MPH -
Manned Camera) committed at Lumber Lane, Burtonwood, Warrington towards
Collins Green in the 12 months to 31/03/2019.

registered within 10 miles of the above address.

Our Response: to your above request sent 09/05/2019

In accordance with section 1(1) (b) of the Act, our response to your
request is as follows;

1.    Can you please confirm the total number of offences (Exceed 30 MPH -
Manned Camera) committed at Lumber Lane, Burtonwood, Warrington towards

2.    Can you also please confirm the number of offences committed by cars
registered within 10 miles of the above address.

Information not held.

Your request for an internal review received 02/07/2019

Dear Cheshire Constabulary,

Please pass this on to the person who conducts Freedom of Information
reviews.

I am writing to request an internal review of Cheshire Constabulary's
handling of my FOI request 'Lumber Lane, Burtonwood, Warrington towards
Collins Green'.

Can you please respond to the second part of my request re. registration
details

Thank you

A full history of my FOI request and all correspondence is available on
the Internet at this address:
[1]https://www.whatdotheyknow.com/request/l...

My response:

I have reviewed the response provided to you in the above correspondence,
in doing so I have established that Mr Basford was indeed correct relating
to your second question that no information is held.  In an attempt to
assist you further under Section 16 of the Freedom of Information Act 2000
please see my following explanation.

When a speeding offence is detected we would look at the registered keeper
details to send the Notice of Intended Prosecution,  which the police
obviously do hold.  The FOIA (freedom of Information act) relates to
recorded information and is not to create information for the purpose of a
FOI request.  In order to establish if the requester lives within a 10
mile radius of the above address would require a google maps search of
each address  to establish if they live within a 10 mile radius.
Therefore the information is not held by the Constabulary.  Unfortunately,
I am unable to assist you by providing the address details for each
speeding offence in order for you to search as this would be deemed
personal information and would be exempt in accordance with Section 40 of
the FOIA Personal Information.

Under the Freedom of Information Act 2000, should you have further
recourse for appeal, if required, to the Information Commissioner.
Information can be obtained about the appeal procedure from:

The Information Commissioner

Information Commissioner’s Office

Wycliffe House

Water Lane
