LPA 1925 s.136 Deed of Assignment

1.Does your council tax billing authority assign information and data to any partnership service provider or other organisation for the purpose of collection and enforcement of council tax.
2.Please provide a list and give the precise name and/ or company number you have a data sharing policy with. If this is an internal partnership, provide the name of the partnership and department within this partnership and confirm who you share these services with and how they are authorised and who by to process and share this data.
3. Do you give notice of this assignment to the data subject whose data has been assigned or does your assignee give notice instead. And at which stage is a data subject's data processed and shared with your agents.
4.What chose in action and upon which assignment is a claim bought by the council and/or your agents for enforcement. Please state whether the council billing authority agency or other service provider agent is bringing the claim on behalf of your council, in the name of the Council.
5. Please provide the precise sections of the acts,rules and regulations that confirms payment of council tax is mandatory.

I write in response to your above Freedom of Information request, received
in this office on 14 March 2021.

1.Does your council tax billing authority assign information and data to

The responsibilities of the contractors with regards to data protection
and sharing are set out in the terms and conditions of the contract

3. Do you give notice of this assignment to the data subject whose data
has been assigned or does your assignee give notice instead. And at which
stage is a data subject's data processed and shared with your agents. 

A letter is issued to the data subject by the billing authority at least
14 days prior to the assignment of a case to the enforcement agent.

The enforcement agents issue a compliance letter to the data subject on
receipt of the case.

4. What chose in action and upon which assignment is a claim bought by the
council and/or your agents for enforcement. Please state whether the
council billing authority agency or other service provider agent is
bringing the claim on behalf of your council, in the name of the Council. 

We are uncertain as to what the first sentence of this question is
asking. The enforcement agents act on behalf of the billing authority,
however.

5. Please provide the precise sections of the acts,rules and regulations
that confirms payment of council tax is mandatory.

The primary legislation is The Local Government Finance Act 1992. Details
of specific legislation relating to the administration and enforcement of
Council Tax are set out in the Council Tax (Administration and
Enforcement) Regulations 1992 (SI 1992 NO 613) as amended.

I trust that this response is satisfactory. If however you are
dissatisfied with this response you have a right to appeal to an
independent officer within the council. They will re-examine your request
and assess whether we have adhered to the requirements of the act. Should
you wish to follow this course of action please address your concerns in
writing to the above address.

You also have a right under Section 50 of the Freedom of Information Act
to ask the Information Commissioner to decide whether we have met with our
obligations under the act.  The Commissioner has however made it clear
that she expects all applicants to exhaust internal appeals procedures
prior to making such an application. Should you wish to contact the
