Local Government Act - Duties and Liabilities

Dear Ceredigion Council,

Please can you confirm that you operate under the Local Government Act 1888 CHAPTER 41 51 and 52 Vict as required by law.

And that in Chapter V Under the heading Proceedings of Councils and Committees.

Section 72 (2)
All duties and liabilities of the inhabitants of a county shall become and be duties and liabilities of the council of such county.

And as I am one of the Inhabitants in the County of Ceredigion and you are the Council that operate in Ceredigion. What procedure do you have in place be for me or any other Inhabitant in Ceredigion to present you with our Liabilities?

Dear Kevin,

 

Thank you for your below Freedom of Information request.

 

I can confirm that Ceredigion County Council, like all local authorities,
operates under all legislation currently in force.

 

Although you have quoted s.72(2) below, I believe you perhaps meant to
refer to s.79(2) which contains the paragraph relating to liabilities. As
you may know, “liabilities” are defined under the Local Government Act
1888 at section 100 and was not drafted to include inhabitants’ personal
debts or taxes which is what the Council believes you may be referring to
when you refer to presenting to the Council your liabilities.

 

Therefore in response to your below request, the Council does not hold any
information in relation to you request.

 

I hope the above information is of assistance, however if you have any
complaints in relation to this FOI response the Council does operate an
internal appeals procedure. If you wish to utilise this procedure then

Dear Louise Parry,

My sincere apologies I was referring to Local Government Act 1888 section 79(2)

The request was not for my personal gain only to clarify 'What would be the duties and liabilities as inhabitants in the County of Ceredigion that we can pass on to you?

And what would the procedure be?

No personal attempt to interpret the Act has been undertaken. The definitions of the wording used are clearly set out in section 100 and requires no further interpretation.
