Dear Care Inspectorate,

Under the Freedom of Information (Scotland) Act 2002 how many local authorities are recorded as having been sanctioned by the Care Inspectorate for serious breaches of the social work employers Code of Conduct relating to Data Protection Act 2018 breaches [i.e. unlawful actions that were not reported to the Information Commissioner's Office (ICO) in a timely way] since the General Data Protection Regulations (GDPR) came into effect on 25 May 2018?

Freedom of Information (Scotland) Act 2002

 

Thank you for your request dated 3 March 2021 under the Freedom of
Information (Scotland) Act 2002 (FOISA) for:

 

“Under the Freedom of Information (Scotland) Act 2002 how many local
authorities are recorded as having been sanctioned by the Care
Inspectorate for serious breaches of the social work employers Code of
Conduct relating to Data Protection Act 2018 breaches [i.e. unlawful
actions that were not reported to the Information Commissioner's Office
(ICO) in a timely way] since the General Data Protection Regulations
(GDPR) came into effect on 25 May 2018?”

Our response

 

The Care Inspectorate has a duty to formally tell you that under the
Freedom of Information (Scotland) Act 2002, Section 17, Notice that
information is not held, we do not hold the information you have
requested.   The reason we do not hold this information is because the
Care Inspectorate regulate services providing care and not the Local
Authorities. I can confirm that within the set timeframe only two local
authority based care services have had enforcement action carried out
against them neither of which were in relation to the Data Protection Act
2018 or GDPR.

 

Right to review

then you may ask for a review.  If you wish to instigate a review then you
