Dear Her Majesty's Treasury,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Her Majesty's Treasury's handling of my FOI request 'Loan Charge Judicial Review Pre Action Protocol'.

HMT have previously issued the letter sent prior to the Pre Action Protocol, and they have also issued the response sent to Loan Charge Legal in reply to that letter. Both of these have been issued via a FoI request. The first of these was even issued when it was wrongly referred to as Pre Action Protocol.

Therefore, there can be little justification to withhold the Pre Action Protocol letter which may have been issued, or to state that none has been received. The letter will form part of any judicial review proceedings which may then seek permission to be granted, and will therefore not be prejudicial to any proceedings. There is no rationale to refuse the FoI request and therefore you are requested to respond to the original request.
