hi,

Unfortunately in NICS , as we know, Note and File Only Requirements take precedence over FOI Obligations in the case of targeted people, people like me. I don't know how many of us there are, figures for this kind of thing are hard to come by, but I suspect it may be a lot.

Whatever the number, this is something I'm trying to have fixed but in the meantime could you maybe just make a quick phone call to Clarence Court or drop them a quick email? When you find out could you maybe get back to me, if that is permitted?

Rather than make a fuss, this might be a quick workaround.

Dear FOI,

Thanks very much for the rapid response and the update. Don’t worry, Note and File Only Requirements can be very restrictive for us all. Misunderstandings can so easily occur when communication is banned, unviability can become inevitable.

While totally incompatible with FOI legislation, no one of course judges the individuals involved. Do please continue to keep in touch in so far as you feel able.

Experience is that in these Note and File cases the important thing is that lines of communication, (even if officially banned) with ostracised people are, so far as possible, kept at least a little open so politicians, analysts, investors, markets, medics and other interested parties can continue to at all times act on the most up to date information possible in the circumstances.

Good Luck. I wish you well and, rest assured, the situation will of course continue to be monitored for signs of progress .

Hi, I don’t want to seem impatient, far from it.

The thing is, records show, that the Roads Minister involved claimed at the time to have undertaken a full investigation and is therefore on his own admission hugely well placed to advise on his findings.
His notes and records relating to all unresolved matters will of of course have been retained in accordance with regulation.

When underwriters , loss adjusters etc are assessing liabilities, premiums etc, etc they may need a quick chat with a Government representative and it really would be great if the name of the investigating Minister were to hand.

Dear FOI,
I have noticed, some organisations are advising, that their staff somehow feel uncomfortable even threated, fearful or harassed at being asked to deal with, Queries from someone like myself. As an officially designated, officially silenced, lesser person, a lower caste, formally ostracised, blackballed individual, someone officially labelled as fit only for Noting and Filing, and with whom all Communication is officially banned, I understand. Those familiar with the history of the province do to.

Maybe the staff involved fear for their own jobs if they are detected communicating in any way with someone beneath them, someone that they are formally ordered to ignore. Maybe, given current sacking levels, they have such fears with good reason too.

I see their point. It is not my wish to make anyone feel in any way uncomfortable or threatened with adverse markings for insubordination , with defenestration, or even with the loss of their own job.

Rest assured if you or your staff feel this way, or if you would prefer, no reason given, that communications from such as me are discontinued, just let me know. I will of course be happy to oblige.

Equally, immediately you feel able to resume communication, again just say.

Dear FOI,

Hi, In view of the possible interest, at their entire wise discretion of NSPCC, it really is important that we , privately or publicly, establish the identity of the NIO Minister responsible for Roads back in Dec 1998 or Jan 1999 and who undertook a full intensive and exhaustive investigation into the child exploitation scandal then.

If there is any problem with this, if the Minister involved perhaps finds it vexatious to be asked a few quick questions don't worry this WDTK Query can be quietly withdrawn provided we can have an assurance that NSPCC will be at all times be accorded the fullest possible co operation in their unremitting efforts to drive out the scourge of child exploitation and thus improve child mental health in the province. Everyone will benefit.

I look forward to such assurance please, so that matters can proceed. Whether such assurance of the co operation of the both NIO and the Minister is given either privately or publicly doesn't really matter.
What does of course matter is that the vital work of NSPCC is not in any way impeded.
