Thank you for your prompt reply to my written request for information regarding licensed HMOs in the Wakefield area. Unfortunately, I am unable to provide you with a reference number as none was detailed in your letter. However, you received my request 10/04/17 and duly responded on 11/04/17.

I am aware that that this information was made available under another FOI request in 2015, and that that information can be accessed on the What Do They Know website under requests made to Wakefield City Council. The information was provided by Galian Smithson, an FOI officer at County Hall, and it appears that no fee was required.

Hello Ms Byrne,

Please accept my apologies for any confusion, and for the omission of the reference number on our previous e-mail (it is FOI 10270).

The acknowledgement we sent to you is a standard one used in all cases. This is because, on the exceedingly rare occasions where a fee is applicable under the Act, it cannot be legally asked for if the requester has not been advised of the possibility at the acknowledgement stage.
You are quite correct in stating that previous requests of this nature have been processed without the need for charging, and I can see no realistic reason why we would do so on this occasion. It is merely a legal requirement under the Act that we inform all requesters of the (albeit)
remote possibility that a fee may be applicable.

I hope that this answers your query to your satisfaction and provides reassurance.

We have redacted a licence holder's address from the response as we have strong grounds to believe it was wrong and it could have been unfairly causing a nuisance to the occupant of the address given.

We have contacted the council to seek to confirm our understanding.
