Please also supply a list of ex-council housing (ie properties bought out under right-to-buy etc).

Dear Hartlepool Council,

 

Please supply a list (spreadsheet or similar is fine) of all council
housing under your remit –

 

We believe that the information requested is exempt from disclosure, as
this is considered to be personal information and is exempt from
disclosure under Section 40 (2) of the Freedom of Information Act 2000.
This is necessary in order to protect the rights of third parties to
privacy and confidentiality.

 

We consider that the absolute exemption set out in Section 40 (Personal
information) subsection 2 applies to the information requested because to
release it would be a breach of the Data Protection Act 2018. Personal
Information is governed by the Data Protection Act 2018 (DPA) and relates
to data of a living individual who can be identified from that data. The
withheld information is exempt because disclosure would contravene the
first data protection principle which requires that personal data is
processed fairly and lawfully. Disclosure of the requested information
would breach this principle and in particular the requirement of fairness
because individuals have a reasonable expectation of privacy and do not
expect that the council would disclose this information in response to a
Freedom of Information request.

 

Please also supply a list of ex-council housing (ie properties bought out
under right-to-buy etc) – For the purposes of s1 of the Freedom of
Information Act, the Council do not hold the requested information because
the Council transferred it’s housing stock to a Registered Provider in
2004.  You will need to contact Thirteen Group.
