Thank you for your email dated 2 May asking for a list of all doctors who
have either been suspended or erased from the GMC register for fitness to
practice reasons. I’ve considered your request under the Freedom of
Information Act 2000 (FOIA). I am sorry for the delay in my response and
any inconvenience this may have caused you.

 

I have attached a list of doctors who have received a suspension (as a
final sanction) or erasure from the GMC register for fitness to practice
reasons between 1 January 2019 and 30 April 2020. We would only revoke a
doctor’s licence to practise for disciplinary reasons if their
registration was suspended or erased. This list does not include interim
suspensions (while an investigation is ongoing) or immediate (during the
appeal period after a final sanction has been imposed). Please note that
it is possible that some of these doctors may no longer hold registration
or a licence to practise.

 

The names of some doctors who received sanctions within this time period
have not been included. This is because we only publish details in line
with the time limits set out in our disclosure policy- please find it
here:

I have not provided information relating to the reasons for the sanction
imposed as the information is already publicly available on the doctors
record on GMC [2]online medical register, using the reference numbers
provided, or on the [3]MPTS hearing and decisions page. As this is already
publicly available, there’s an exemption under the FOIA which applies –
details about this are given below. In relation to the names and details
of doctors whose details are no longer published, we consider S40(2) of
the Freedom of Information Act 2000 to apply and the information is
exempt.

 

The exemption

 

Section 21

 

This exemption applies where the information is already reasonably
accessible to the requester, even where a charge may be applicable.

 

Section 40(2), by virtue of section 40(3)(a)(i)

 

This exemption applies where the information is the personal data of a
third party and where releasing the information would breach any principle
of the DPA. In this instance disclosure would breach the first principle
of the DPA, which requires the processing of information to be 'fair and
lawful'. I believe the conditions in Schedule 2 of the DPA, which are
about the processing of personal information, are not met and therefore
giving you the information would be unlawful.

 

Your right of appeal

 

Even though I’ve provided you with details of where to find the
information, I still need to mention that you can appeal my decision to
apply the above exemption. You can appeal against this decision to the
Information Access Manager.  If you would like to appeal this decision
please set out your reasons in writing to [4][GMC request email]. Please note
that we will only usually consider appeals received within 40 working days
of our response. You can also appeal to the [5]Information Commissioner,
the regulator of the FOIA and DPA.
