Dear Sir or Madam

FREEDOM OF INFORMATION REQUEST – Ref No: 009417

Thank you for your request of 29 May 21 where you requested:

I would like to request a list of all HMO licencees within the Ashfield
remit.

The information you requested is attached.

I can confirm that Ashfield District Council holds this information.  The
information is exempt under Section 21 of the Freedom of Information Act
(FOIA), because the information is accessible to you, as it is already in
the public domain.  The Council is able to fulfil its duty under Section
232 of the Housing Act to make this information available as a full
version of the register is available for inspection upon appointment at
the Council.  The Housing Act 2004 does not obligate the Council to
provide this information electronically, nor does it negate the Council’s
commitment and responsibilities under data protection legislation.  In the
interests of advising and assisting, the Council has attached a document
with many details of the HMO register provided.  Certain personal data has
been removed as, whilst a matter of public record, the Council must still
process this in accordance with the Data Protection Act 2018 and the GDPR.
The Council considers the means of distribution important here, and
disclosure of the data electronically creates an unfair ease of access to
such a large number of people which could potentially breach the first
data protection principle in Article 5 of the GDPR.

This is an absolute exemption and there is therefore no requirement to
consider the public interest.

Copyright and re-use

Most of the information that we provide in response to Freedom of
Information requests will be subject to copyright protection.  In most
cases the copyright will be owned by Ashfield District Council.  The
copyright in other information may be owned by another person or
organisation, and this will be indicated on the information itself.

You are free to use any information supplied for your own non-commercial
research or private study purposes.  The information may also be used for
any other purpose allowed by a limitation or exception in copyright law,
such as news reporting.  However, any other type of re-use, for example by
publishing the information in analogue or digital form, including on the
internet, will require the permission of the copyright owner.

For information where the copyright is owned by Ashfield District Council
details of the conditions on e-use can be found on our website at
[1]https://www.ashfield.gov.uk/your-council....

Your privacy

We use your personal information such as name and address so that we can
comply with our legal obligations to respond to Freedom of Information
requests.  For further details about the use of information about you,
please see the privacy notice on our website at

Complaints

If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review.  Internal review requests should be
submitted within two months of the date of receipt of the response to your
original letter and should be addressed to: Freedom of Information, Legal
Services, Ashfield District Council, Urban Road, Kirkby-in-Ashfield,
NOTTINGHAM, NG17 8DA or [3][Ashfield District Council request email].

Please remember to quote the reference number above in any future
communications.

If you are not content with the outcome of the internal review, you have
the right to apply directly to the Information Commissioner for a
decision.  The Information Commissioner can be contacted at: Information
Commissioner’s Office, Wycliffe House, Water Lane, WILMSLOW, SK9 5AF or

Yours faithfully
