Thank you for your message yesterday.  Unfortunately despite the extension
of the original timescale we are not yet in a position to provide you with
the figures you requested on 6 November 2014, when you asked for
information on flood defence projects that are/have been over budget in
the financial years 2012/13 and 2013/14.

 

The process of retrieving the relevant data has not been straightforward,
and has involved several teams in checking the accuracy of the figures
obtained from our records. We have identified approximately 200 projects
nationally within the two financial years of your interest, and find that
a small number of those fall within the scope of your request (i.e. the
estimated costs were smaller than the final costs).

 

The delay has been caused partly by the fact that many staff were on leave
over the Christmas and New Year period, and partly because we found it
necessary to change the way we are conducting the searches necessary to
extract the relevant data. As some of the projects completing within the
two year period were already in progress at the start of the period of
your request, we need to look across three systems throughout the life of
each project to get the information – the records of project completion,
the finance system and the change control data base.

We run our budgeting system on an annualised basis so it can take time to
drill down to find the spend during the life of the project from the
relevant database.

 

We apologise for this, and hope to provide you with the completed response
by 30 January 2015 at the latest.  We acknowledge that this delay is a
breach of the statutory 20 working day period under the Environmental
Information Regulations, and that we have already extended the time under
Regulation 7 on the grounds that the material is both complex and
voluminous.

 

However, we can say that we wish to provide accurate and complete figures
to answer your query and we would point out that information held by
public authorities is not always held in a format which enables the
authority swiftly to extract the material requested; in this case our data
is used to support the business needs of the Flood & Coastal Risk
Management directorate.

the financial years 2012/13 and 2013/14. Specifically, you asked for:

 

1.     A list of all flood defence projects that are/have been over budget
in the financial years 2012/13 and 2013/14 along with initial budget and
actual spend for all the flood defence projects that were over budget.

 

We respond to requests for recorded information that we hold under the
Freedom of Information Act 2000 (FOIA) and the associated Environmental
Information Regulations 2004 (EIR). Again, please let me apologise for the
delay in returning this response to you.

 

Background

 

Business cases are developed for all capital projects and this includes
assessment of the expected costs of the project. As a project develops
from the conceptual, through design stages to completion, estimated scheme
costs can change. For assurance purposes, we record and approve such
changes to the revised cost of completing the project.

 

There are several factors that can result in the cost of a scheme changing
from the original approved value, including, but not limited to:

 

·        as business cases are developed cost estimates are refined and
the balance of capital construction cost and long term maintenance cost
may change

·        estimates of compensation costs may change as negotiations
proceed. This can sometimes be after projects are completed

·        unforeseen or unexpected costs - for example flooding, heavy rain
affecting ground conditions, unknown utility services, etc

·        change to the extent of the works or the nature and form of
structures.

 

Before a scheme can proceed a full business case needs to be approved by
Environment Agency financial and operational management teams. We also
require a fully revised business case to be approved for any individual
projects which exceeds its approved contingency allowance.

 

Between April 2012 and the end of March 2014, the Environment Agency’s
capital investment was £584m enabling 200 projects to be completed which
helped to reduce flood risk to over 90,000 properties. Of these projects,
9 involved such authorised cost changes. They are:

The details show that the cost of these schemes varied by approximately
£10 million, changing from £30.5 million to £40.5 million over the 2
years. The majority of this variation (approximately £7.2 million) can be
attributed to 2 schemes:

 

·        Medmerry Managed Realignment Scheme

·        Steeple Bumpstead Flood Risk Management Scheme

 

The change in costs for the Medmerry Managed Realignment Scheme primarily
resulted from the exceptionally wet weather from April to December 2012,
which caused a significant delay to the major earthworks programme; where
excavated clay was being dug from borrow pits on site to form the new
flood embankments.

 

The costs associated with the Steeple Bumpstead Flood Risk Management
Scheme changed as a result of planning requirements, and delays to the
construction programme as a direct result of the exceptional rainfall
during winter 2013/14.

 

Although scheme costs increased by approximately £10 million between April
2012 and the end of March 2014, the Environment Agency made efficiency
savings of approximately £37.7 million in capital construction costs
during this period.

Thank you for your request asking for an internal review into our handling
of your Environmental Information Regulations request NRNOV22.

 

You state that the ‘request took far in excess of the time expected’ and
that you ‘believe not all the information requested was given’.

 

We wrote to you on 4 December 2014 and 6 January 2015 to inform you that
as the material was both complex and voluminous, it would take us longer
than usual to respond to your request. Additionally, delays were also due
to staff members being on leave over the Christmas and New Year period.

 

On the 26 January 2015 we sent you a list of all projects that were over
budget, and the detail of the difference between projected spend and
actual in each case for the two years you requested.

 

We feel that we have already provided you with an explanation into why the
request took longer than was expected. We have also provided you with the
information that is relevant to your request.

Hello Henry ! The Salmons Brook Flood Alleviation Scheme (North London) will also be investigated for running over budget and over time (currently over a year late). The same excuses as to why public money appears to have been misspent by poor management and lack of control have been used throughout - particularly the 'exceptionally wet weather card'. It appears that this public body sees itself as above account to the public. Keep fighting for answers - we are!

Review of Freedom of Information/Environmental Information Request

 

Request for a review in respect of information relating to NRNOV22
released on 26 January 2015

 

I refer to your e-mail dated 30 January 2015, in which you advise us that
you requesting an internal review of the information that we released to
you in regards to your request of 6 November 2015.

The Environment Agency received the request on 6 November 2014 and we
responded to that email on 26 January 2015.

 

 

Review

I have conducted an internal review and I have concluded that we did
release all the information that was relevant to your request. In total we
identified 200 projects within the 2 financial years that you requested.
Each scheme was reviewed to determine their original cost compared to
their final out-turn costs to see if any of the schemes had been over
budget.

In total we found that 8 schemes out of the 200 were over budget (1 scheme
was also completed under budget). Information on each of these 9 schemes
was provided to you, including the initial budget, final out-turn costs,
and the variance between these costs.

In your request for review you stated that you had not been provided with
all the information that we held. We asked you for clarification about
this in order to try and identify what information you thought had not
been provided but we did not receive a response. I therefore carried out a
review of the information held, and the searches that were made and find
that all the information held was provided to you in our response of 26
January 2015.

 

 

Service levels

I find that we did not comply with our duty to respond within the
statutory timescales. We apologise for our failure to comply with the time
limits.

This was caused by the information that you requested not being held in a
format that enabled us to easily extract the relevant information.
Additionally, delays were also a result of staff members that were
required to obtain and check the accuracy of the data being on leave over
the Christmas and New Year period.

 

 

Right of Appeal

If you are not satisfied with this review of the information that we
released to you, you can make an appeal to the Information Commissioner,
who is the statutory regulator for freedom of information.
