Dear East Devon District Council,
I make this application for information under the FOI and Environmental Regulations to determine what information is held on the input by Planning and Countryside Services into the processing of the licensing application by

Mickey's Beach Bar & Restaurant and Cafe Patisserie Glacerie
Unit 1, Sideshore, Queens Drive, EXMOUTH, EX8 2GD
Completed application 051731

I am requesting details of all of the information Planning and Countryside Services hold on this application. I am also requesting the fullest information about any and all meetings that they may have had with Licensing, the applicant and or his representative, dates, parties involved, locations of any meetings. Please include also all the information held on computers, copies of all correspondence, printed or handwritten documents, emails, records of telephone calls, as well as images, video and audio recordings of meetings that may have been made.

A formal appeal against the granting of this licence is being considered and, as the time for appeal is limited, I would emphasise the obligation under the FOI Act to deal with requests promptly. A prompt response would also assist the court and remove the need for an adjournment.

Service(s) this request is directed towards as it refers to EDDC in
general and the Environmental Health Service. This could potentially mean
every service within the council and is likely to take in excess of the

Thank you for your response to my requests. I hope this note will clarify your confusion.

I made two separate FOI requests through the WhatDoTheyKnow website.

Each request was about the involvement of one specific service within EDDC, the first concerned Environmental Health & Wellbeing and the second Planning and Communities. Both requests are regarding each service’s involvement with the Licensing application 051731.

It may help you to provide some background information to my submission of these two FOI requests. I had a problem using the WDTK website – both my requests ‘disappeared’, so I made two further requests which also ‘disappeared’.

Following my communication with their Helpdesk, WDTK addressed their website issues and two copies of each request then subsequently appeared and were forwarded to you. Perhaps the appearance, beyond my control, of four FOI’s may have caused confusion.

However, I will now try to be explicitly clear in answering the specific question you have asked. You have asked “which Council Service(s) this request is directed towards as it refers to EDDC in general and the Environmental Health Service?”

I am requesting in one FOI details of all of the information Environmental Health & Wellbeing Services hold on this application. I am also requesting the fullest information about any and all meetings that they may have had with Licensing services, the applicant and or his representative, dates, parties involved, locations of any meetings in respect to Licensing application 051731. Please include also all the information held on computers, copies of all correspondence, printed or handwritten documents, emails, records of telephone calls, as well as images, video and audio recordings of meetings that may have been made in respect to Licensing application 051731.

I am requesting in the second FOI details of all of the information Planning and Community Services hold on this application. I am also requesting the fullest information about any and all meetings that they may have had with Licensing services, the applicant and or his representative, dates, parties involved, locations of any meetings in respect to Licensing application 051731. This email clarifies the focus of the FOI’s are Environmental Health & Wellbeing Services and Planning and Community Services so there is no potential to involve every service in the council.

I am hopeful that you will find this email resolves your confusion and provides the information and details that enable you to proceed with my requests without further queries.

I am disappointed 10 days has elapsed before you sought clarification on your confusion, as this has now presented a challenge for you in meeting your undertaking to deal with this request as quickly as possible, and within the 20 working day statutory deadline under the Freedom of Information Act 2000.

Countryside have had no involvement regarding this application. The
