Dear Crown Office,

In the London Gazette, Issue 60048, page 1865, the following notice is included:

"Crown Office
House of Lords, London SW1A 0PW
1 February 2012
Letters Patent dated 1 February 2012 have passed the Great Seal of the Realm cancelling and annulling the Knighthood conferred upon Frederick Anderson Goodwin on the 25 November 2004 as a Knight Bachelor.
C.I.P, Denyer".

Under the Freedom of Information Act 2000 (FOIA), I would like to request access to these Letters Patent. If it is impracticable to provide a scan of the sealed Letters Patent, I would be happy to receive a copy of the final draft in text form.

Please note that Section 37(1) (b) (FOIA) only refers to information related to "the conferring by the Crown of any honour or dignity", but not to the cancelling and annulling of honours and dignities. On plain reading of the statute text, this exemption is therefore not applicable in this case.

your reference: 74717

From your response letter and from the forwarded internal email, I believe there has been a misunderstanding, as you have referred to the Crown Office in Edinburgh (the Scottish prosecution service).

What I meant was the Crown Office in the House of Lords, which supports the Clerk of the Crown in Chancery. The Crown Office is headed by Mr Ian Denyer and Mr Grant Bavister and it is administratively part of the Ministry of Justice, because the Clerk of the Crown in Chancery is the Permanent Secretary of the Ministry of Justice.

In the past, FOIA requests to the Crown Office in the House of Lords were always made through the Ministry of Justice which forwarded them to Mr Denyer and Mr Bavister.

Could you have another look at my FOIA request per the above?

thank you for your email. I note that you acknowledge my email "of 6 February".

Without wishing to be a nuisance, may I just point out that I originally made this request on 1 February, to which the Ministry responded on 2 February, though clearly in a way which showed that it had not understood my request correctly, and I followed up on the same day, 2 February.

I am assuming that the date of 6 February refers to the fact that you were internally forwarded my request on that date, though of course for the purposes of the Act, 2 February will be relevant.

Dear Mr. Bimmler,

Thank you for notifying me of the discrepancy between the dates as stated in my letter to you. I have spoken to the case allocation team in the Data Access and Compliance Unit to clarify. It seems there was a typing error on the allocation note they supplied me and that the date of your correspondence should have indeed read 2nd February (the date your request was clarified). Despite this error, I'm pleased to say that the statutory 20 day deadline quoted in the letter (1st March) was correct.
