We are still waiting for a valid response to our request dated 30th January. We've asked the ICO to now concentrate on their claim that they did not receive our message on 25th February despite the WDTK log showing they did actually receive it.

Dear Department for Work and Pensions,

I am writing to request an internal review of Department for Work and Pensions's handling of my FOI request 'Letters and memos of complaint sent from CHDA'.

We have been advised by the ICO [IC-42873-P0D7] to request an internal review of the handling of this request. While we accept the department eventually notified us that it did not hold the information requested, we wish to focus on its claim in internal review code IR2020/18297 that it did not receive the notification we sent on 25th February (link below) to confirm what we asked for is what we wanted as oppose to something we did not ask for.

The internal review went on to state "no evidence" can be found to suggest our message was received by your server. We object to this because it flies in the face of the public WDTK log which clearly states that the message WAS RECEIVED BY YOUR SERVER - because YOUR SERVER NOTIFIED THE WDTK SERVER that it received our message. This fact cannot be disputed given that log. You cannot therefore claim there is 'no evidence' that the message was received. The reason this is relevant is because your department claimed this was the reason for the long delay in responding to our request.

Having notified the ICO of this, they recommended you carried out another internal review, this time focusing on this area of complaint before they take over. We require you to properly investigate the points listed and report your findings.
(1) Why you failed to respond to our message dated 25th February considering the fact your own server notified the WDTK server that it had in fact received the message (proof in the link below).
(2) The internal reviewer's claim that there was "no evidence" that our message had been received given the fact that YOUR SERVER notified the WDTK server that our message HAD been received. In other words ignoring proof can hardly result in a conclusion of "no evidence". If the reviewer had checked the log files they would have seen the message was received.

Our proof shows it was YOUR SERVER that assigned OUR MESSAGE with number 6837445, so all you have to do is search your email server for that number on date 25th February to confirm what we're informing you is correct before the ICO take over. But the fact that YOUR SERVER informed us of this number proves YOUR SERVER DID RECEIVE THIS MESSAGE.

WDTK separately confirm to us that the message number would have been generated by DWP's email security gateway (Cisco Ironport), so it must have received our message in order to assign it with a number.

Thanks for your internal review IR42182 which was the ICO's way of giving you a final chance to correct this matter before they take over.

Our response to your internal review is as follows:

You have again chosen to ignore the key element in this matter which was the traceable message reference number issued by your own server of 6837445 to the WDTK server. You were also supplied with the log in full and chose to ignore that too.

It's simply no good looking in places where you KNOW the message WILL NOT BE in order to back up your original claim that the message wasn't received BECAUSE inbox contents are open to deletion (accidental or otherwise).

You should have done as we asked and trace the message by the number we gave you which was issued to the WDTK server by your server.

Given the fact you are obviously trying to cover something up by not carrying out what we requested, this matter will now finally be investigated by the Information Commissioner.

Given we were able to provide proof that our message was in fact received the Information Commissioner agreed with us and will write to the DWP to remind them of their duty. Then the matter may be closed.
