Please provide details of all the covenants or other restrictions on use that Rugby Borough Council (or its predecessor bodies) entered into when the Shakespeare Gardens Amenity Green Space was first brought into public ownership.

Dear Ms Allanach,
Re: FOI request concerning covenants or other restrictions on the use of
Shakespeare Gardens open space
Dunchurch Gardens Limited conveyed the land at Shakespeare Gardens to the
Mayor Aldermen and Burgesses of the Borough of Rugby in two parcels – the
first on 3 October 1960 and the second on 6 July 1962.
The deeds contain the following covenant for both parcels:
“…. the piece of land hereby conveyed will be forever kept as an open
space.”
Paragraph 20 of the Open Spaces Act 1906 defines ‘open space’ as follows:
“The expression ‘open space’ means any land, whether inclosed or not, on
which there are no buildings or of which not more than one-twentieth part
is covered with buildings, and the whole or the remainder of which is laid
out as a garden or is used for purposes of recreation, or lies waste and
unoccupied.”
