Thank you for your patience in awaiting our response.
As per my previous email, NHS SBS is not listed as a public authority under the FOI Act and for this reason we are not obliged to release information under this legislation.
With regards your query concerning the bid documents being available previously in the public domain - following the closure of any tender, documents of this nature are not routinely made available to individuals/organisations upon request.
This is due to the content of these documents, specifically data of a commercially sensitive nature contained within the bid pack. This information would only ever be accessible to those seeking to submit a bid under an open tender, with the ability to view the bid pack removed once the tender is closed. This is routine practice within organisations providing services of this nature in order to protect intellectual property rights and prevent the onward use of materials produced.

Further to the below, this request has been escalated to our Head of Information Governance, Risk & Assurance for further review.
Their decision re this FOI is to uphold the initial position not to provide the information being requested. The holder of this role was not in post when the request referenced from 2017 was received, therefore cannot comment on decisions made at that time.
Any previous provisions from previous years were determined on a case by case basis and do not influence the static position that NHS SBS is not subject to FOIA.
