19 October 2018. The Department takes very seriously its obligations under
the Freedom of Information Act and we are sorry for the delay in
responding in November. This was due to the time it took to thoroughly
investigate your matter and we regret any inconvenience the delay may have

I have dealt with your request under the Freedom of Information Act 2000
(“the Act”).

We estimate that gathering the information would exceed the cost threshold
relating to Freedom of Information requests: that is £600 or
two-and-a-half days of Executive Officer time. The information is held by
the Government Legal Department which deals with litigation on our behalf.
They would have to retrieve and examine nearly 1,000 case files to find
the information requested.

 

Under section 12 of the Act the Department is therefore not obliged to
comply with your request and will not be processing it further.

 

I have considered ways in which your request might be narrowed or limited
in order to reduce the cost of complying with it. However, due to the
nature of your request and the way in which the information is held, I
consider that we would still be unable to provide any helpful information
even if you narrowed your request.

If you have any queries about this letter, please contact me. Please
remember to quote the reference number above in any future communications.

If you are unhappy with the way your request has been handled, you should
make a complaint to the Department by writing to me within two calendar
months of the date of this letter. Your complaint will be considered by an
independent review panel, who review panel, who were not involved in the
original consideration of your request. 

If you are not content with the outcome of your complaint to the
Department, you may then contact the Information Commissioner’s Office.
