Legal Advice on explicit consent
Dear Department for Work and Pensions,
In this response:
https://www.whatdotheyknow.com/request/u...
you stated that you had taken advice from Legal Advisors on your explicit consent policy.
I would be grateful if you would provide a copy of your instructions to those advisors as well as their advice to you on this matter; otherwise the dates, times, minutes or participants list of any meetings held.
Yours faithfully,
Dan Manville

Thanks John
I suspected that might be the case however I also suspect there will have been meetings rather than formal advice that won't be so difficult to track down.
However... having read some of your work on here I reckon you can probably recall some cases; or at least point me to the resources where I can find them, where such advice has been revealed.

Hi John
Another one of my requests has been refused; quite an important one if you know our game... The consultation on explicit consent request has been refused on the costs limit.
If you can point me to any resources about ICO complaints I'd be very grateful.
Congratulations on the UC Project Management stuff as well!

Please see the attached reply to your Freedom of Information request.
Please accept our apologies in the delay in sending the reply

Dan,
Legal advice falls under the exemption S.42 FOIA. It's a very hard exemption to get round but there are instances where Tribunal's have agreed that the info should be exposed.
