Dear Derbyshire Constabulary,

Operation Herne Report 2 States:

"On the 20 February 2011 legal advice was sought in respect of what offences, if any, may have been committed if an officer deployed undercover embarked on a sexual relationship with an activist. Counsel was asked to consider offences such as rape, indecent assault, and procurement of a woman by false pretences and misconduct in a public office. The written advice received was that in their opinion those offences were that the behaviour alleged did not amount to a sexual offence."

I would appreciate it if you would provide me with a copy of the written legal advice.

Yours faithfully,
James Harvey.

Freedom of Information Office,
