Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Department for Exiting the European Union's handling of my FOI request 'Leaving the single market'.

I wish to request an internal review regarding a rejected FOI. Note your ref: DEX000099

I was informed I should write to: Freedom of Information Team (internal review) Department for Exiting the European Union 9 Downing Street SW1A 2AG. I assume this is the right email for such an address. If it is not, please can you send to the right email and ask them to confirm receipt. If this is the right email can you confirm receipt.

My FOI was very simple. I asked for any briefing papers to Mr Davis MP regarding the benefits and the pitfalls of leaving the single market.

You said that such a request would exceed the appropriate limit. You said that the appropriate limit has been specified in regulations and for central Government this is set at £600. This represents the estimated cost of one person spending 3½ working days in determining whether DExEU holds the information, and locating, retrieving and extracting it.

I cannot believe that it would take one person to find simple briefing nots to Mr Davis MP relating to the single market. Even if you were not able to equip me with all the notes, I feel you can still send me any briefing notes on the single market that you can find in the 3 1/2 days.

The FOI act insists that data be held in such a way as to be made available to the public.

I am sure that there are a finite number of briefing notes given to Mr Davis. I am sure that these are sent to one email, for instance. As such I am sure that a search of that email with the phrase ’single market’ and then extracting all PDFs and Word documents from such a search would take a matter of minutes.

You said I may refine my request in order to bring the cost of determining whether DExEU holds relevant information, locating, retrieving and extracting it, below the appropriate limit. So here is that refinement: please can you spend 3 1/2 days doing this and send me all briefing notes that you find within those 3 1/2 days. Once that 3 1/2 days are passed then your job is done.

That means I don’t go over the deadline, but you also adhere to what is in the law.

Does this sound reasonable to you? It does to me. I am sure, too, that a quick request to Mr Davis’ secretary of any key briefing documents on the single market would quicken the process.
