In light of the fact that Wandsworth Council, under the Leasehold Reform Housing & Urban Development Act 1993 (as amended) has a practice to extend leases by 90 years.
I kindly request a list of all residential lease extensions carried out in the prior 48 month period with unexpired leases of more than 80 years where marriage value was not applied in calculating the Landlord/Freeholder premium.

The following information is requested:

a. Unexpired Years (e.g. 87 years)
b. Agreed Value of property (e.g. £250,000)
c. Agreed premium (e.g. £15,000)

As specific personal and commercially sensitive contractual details are not sought, I respectfully assert this request is not exempt under Section 40 (2) (personal information) nor Section 43 (commercial interest).

I refer to your request for information received on 27/07/2020.  Please
see the information below in response to your request: -

 

In light of the fact that Wandsworth Council, under the Leasehold Reform
Housing & Urban Development Act 1993 (as amended) has the practice to
extend leases by 90 years.  I kindly request a list of all residential
lease extensions carried out in the prior 48 month period with unexpired
leases of more than 80 years where marriage value was not applied in
calculating the Landlord/Freeholder premium?  The following information is
requested:

Wandsworth Council is unable to provide details of individual property
addresses of those who have exercised their right to extend the term of
their lease, as this is classed as personal information relating to that
individual leaseholder.  Releasing personal information relating to other
individuals would breach the Data Protection principles and is considered
to be exempt from disclosure under Section 40 (2)(b) of the Freedom of
Information Act 2000.  Please note that this is an absolute exemption
under the Freedom of Information Act and therefore the public interest
test does not apply.

 

We also consider the premium paid by each property on completion of new
leases to be exempt from disclosure under Section 43 of the Freedom of
Information Act 2000, as it could be used by third parties to affect
future negotiations.  Section 43 states that information is exempt from
disclosure if its disclosure would or would be likely to, prejudice the
commercial interests of any person, including the public authority holding
it.

 

Under the terms of the Freedom of Information Act 2000, this email acts as
a Refusal Notice.
