Thank you for your email of 17 September 2021 in which you asked the
Council to:

 

1. provide me with the lease document for Gilroy road community allotment

2. Provide me with a list of leases for the use of this piece of land from
1950- 2011

 

A copy of the lease was provided to the Gilroy Road Allotment Association
on 22 September 2021 and we understand that this has now been made
available to you.  If this is not the case, there is a publicly registered
copy of the lease available through the Land Registry.

 

In relation to point 2 of your request, the information sought is held in
ledgers stored in the Council’s RM Archives in Cheshire Lines Building. 
Unfortunately, this building is currently not open to staff as a result of
recent flooding so no access to the records can be obtained at this time.

 

We would ask that if you do still require the historic lease information
that you kindly resubmit your request in a few weeks, at which point we
are hopeful to have regained access to the Archives building.

Further to our recent response to your enquiry, we can now provide the
additional information relating to the lease.

 

Records indicate annual grazing leases were issued for the Allotment site
to a local man each year between 1980 and 1996. There was a proposed 99
year lease of the land to a different person in 1997, but this didn’t
complete.  In 1999, 2001, 2002 and 2003 there were proposed 1 year grazing
agreements to different people but all were cancelled.

 

We are unable to provide you with any personal details in relation to the
leaseholders in accordance with Section 40(2) of the Freedom of
Information Act in order to protect the rights of those 3^rd parties.

 

You have the right under Section 17 of the Act to ask for an internal
review in respect of this refusal of your request for information. This

dissatisfied with the result of your internal review, you then have the

Thank you for the information re the lease of the land which is now Gilroy community allotment.
I had asked for lease agreements since 1958, and you provided information since 1980.
Can I please clarify whether
1. WBC didn't lease the land previously?
2. No records can be found re earlier years?

Can I please addionally ask whether the boundaries of the land which was leased before 20 11 are identical with the boundaries of the present allotment site?

Further to your follow up email of 23 October 2021, we can advise as
follows:

 

“Can I please clarify whether ….”

 

 1. WBC didn't lease the land previously?  - Wirral Council came into
existence in 1974 and became the beneficial owner of titles from the
predecessor Council. However, some functions were carried out by
Merseyside County Council, also created in 1974 and this included
responsibility for waste disposal. Wirral Council does not possess
recorded information prior to 1980.

 

 2. No records can be found re earlier years? - No

 

3.    Can I please additionally ask whether the boundaries of the land
which was leased before 20 11 are identical with the boundaries of the
present allotment site?  - Yes
