Dear Mr Walker,

Thank you for your request on 01/06/2020. After careful consideration we have concluded that the information you have requested, the lease held by Craven Cruising Club and the land leased on the Leeds and Liverpool Canal for mooring boats, unfortunately is exempt from disclosure under Section 43(2) of the Freedom of Information Act 2000 as the disclosure is likely to prejudice the commercial interests of the Trust.

I have carried out the public interest test in relation to the application of this exemption. Factors in favour of disclosure are that providing the information can facilitate the accountability and transparency of the Trust.

Factors against disclosure are that the Trust enters into a large number of property and mooring agreements for the business boating sector throughout the trusts waterway network, all of which are negotiated on an individual basis and its negotiating position would be adversely affected, if we disclose the terms for each individual agreement. It is also in the public interest for the Trust to negotiate and obtain the best possible agreement in relation to fees and terms in order to maximise the revenue it has to spend on its statutory obligations. It is also important that the Trust maintains a confidential contractual relationship with its customers to ensure trust and confidence in it as a contracting party. Furthermore, disclosure would damage the Trust’s future ability to negotiate leases competitively. On balance, the factors against disclosure of the information outweigh the factors in favour of disclosure.
