Dear **** ******,

I have received an FOI request from Oysterman. I am refusing to respond to this request because of the use of the pseudonym. In making a request you must provide a name and address for correspondence.

In the past you have made requests for similar information our learning support to which we have complied. I will not continue to respond to repeated requests from you for similar information as responding to such requests is exempted under FOI. You are aware that I agreed an arrangement with you whereby you could have additional time in the Higher English evening class which to date you haven't taken up. I understand that you want to do this soon but also want to understand what additional help is available. The arrangement for additional time we made with you is an adjustment to help you cope with the course. I would suggest that you contact Liz Sanderson, who you have contacted before, so that she is able to explain why we are offering you the extra time and make any other arrangements to assess your particular circumstances and discuss whether there is anything more that is reasonable for us to offer.

Yours sincerely

David Killean

C) Confirmation of whether of not such resources apply to part time

There resources are available to all students.

D) An explanation of how the answers provided in A+C are compatible
with HM Equality Act of 2010
The Equality Act requires the college to anticipate the needs of learners with disability, hence us having these services in place. We are also required to make reasonable adjustment to take account of the disability. The judgement is always what is reasonable - for this we follow the guidance or will seek advice of the Equality and Human Rights Commission.

Each individual should be assessed by us before planning what reasonable adjustment should be made. Examples of reasonable adjustment include giving more time for exams or more time to study before an exam is undertaken.

I hope this answers your enquiry. I would urge you to make use of the offer from Liz Sanderson to meet with her so we can plan a way forward. I also understand that you have decided to withdraw from your maths class. I am sure Angie will be in contact with you to try to find out why you found it difficult to attend and what were the reasons for your withdrawal.

Kind regards
David Killean
