5) The number of new “in-county” supported living Learning Disability care placements that cost over £1000 per week that you have fully or partly funded in 2013.

Section 1(3) of the Freedom of Information Act states that a Public Authority is not obliged to comply with a request if:

1. It reasonably requires further information before it can identify the information requested, and;
2. It has asked the applicant for this information.

In this case, the authority does not need to comply until or unless it has received a response which sufficiently clarifies the request.

We have requested that you clarify the term "out of county" in your request to enable us to search for the information you have requested as this does not specify an exact geographical distinction that correlates to Birmingham City Council's boundary. We would not want to place an assumption on your interpretation. Once we have received such clarification we would then have 20 business days from that date to respond to your request.

If you require any assistance in rephrasing your request in a manner that would enable Birmingham City Council to search for this information please do not hesitate to contact me to discuss.

Your response is inadequate. The original request was made on 17 Jan 2014. You then waited 24 days until 17 Feb to even ask for any information. Why did you wait so long for this simple information?

The information was given on the same day 17 Feb which is repeated below for ease of reference

The Freedom of Information Act requires responses to be prompt and at a maximum 20 days. It is not for authorities to delay matters by waiting 24 days before asking for a simple clarification and then hoping to reset the clock. The clarification was provided on the same do you requested it. Now, by when when will you provide a full response? - The law expects you not to delay.

you have not explained why it took 25 days to have a discussion internally - just that it took 25 days! please provide a full explanation

the information requested by you was provided on the same day through the whatdotheyknow website. It is not acceptable to baldly state that you did not see the information. You are now outside legal guidelines for responding with explanations the Information Commissioner is unlikely to find acceptable. What specific date will I get a full response. Another 20 days as you propose would put you 1.5 months over what the law allows and will not be acceptable. Please revise your date and inform me.

Dear Victoria Martin,

I apologise for not responding to your e-mails dated 25 February 2014 and 03 March 2014, I have unexpectedly been out of the office.

In response to your query regarding the reasons for the initial delay in requesting clarification, at the time of receipt of your request we were undergoing a transition period with the staff supporting the process. Whilst in this instance this did cause delay we are now in a position where this should not reoccur. I can only apologise for the delay.

With regards to the revised timeline on this request my previous e-mail dated 21 February 2014 stated that this would be 20 working days, which would be 21 March 2014. The request is currently with the relevant colleagues who are in the process of collating the information. I will contact you again on or before 21 March 2014 to update and release any information I am able to at that time.
