Dear Beverley Knight,

 

We refer to your email of 10/05/2021 requesting information relating to
“Leadership and management training to trainee doctors”, as held by Health
Education England (HEE).

 

HEE can confirm in accordance with S.1 (1) of the Freedom of Information
Act 2000 (FOIA) that we hold some of the information that you have
requested however some of this information is exempt under Section 43(2)
of the FOIA. 

 

I will address each of your questions in turn:

Q1: Suppliers who applied for inclusion on each framework/contract and
were successful & not successful at the PQQ & ITT stages

 

I should advise you that we are unable to provide you with the names of
suppliers who applied for inclusion on each framework/contract and were
not successful at the PQQ & ITT stages. This is because HEE consider it
exempt under section 43(2) of the FOI Act. This exempts information if its
disclosure under this Act would, or would be likely to; prejudice the
commercial interests of any person (including the public authority holding
it). Information relating to the unsuccessful suppliers for “Leadership
and management training to trainee doctors across all specialties” are
considered exempt under section 43(2) of the Act.

Section 43(2) is a qualified exemption and we are required to conduct a
public interest test when applying any qualified exemption. This means
that after it has been decided that the exemption is engaged, the public
interest in releasing the information must be considered. If the public
interest in disclosing the information outweighs the public interest in
withholding it then the exemption does not apply and must be released. In
the FOI Act there is a presumption that information should be released
unless there are compelling reasons to withhold it.

Considerations in favour of disclosure

HEE appreciates that the public interest can cover a wide range of values
and principles and what is in the best interests of the health economy and
society. For example, there is a public interest in transparency and
accountability, to promote public understanding and to safeguard
democratic processes. There is a public interest in good decision-making
by public bodies, in upholding standards of integrity, in ensuring justice
and fair treatment for all and in securing the best use of public
resources.

Other Considerations in favour of the release of the information include
HEE’s commitment to openness and transparency in its commercial
activities, to allow public scrutiny and to demonstrate that public funds
are being used in an efficient and effective way. Furthermore, private
sector companies engaging in commercial activities with the public sector
must expect some information about those activities to be disclosed.

Considerations in favour of maintaining the exemption

 

Considerations against disclosure include the following:

 

o Releasing information regarding unsuccessful bidders could damage the
business reputation of the supplier, weaking their ability participate
competitively in a commercial activity for the tender of other such
contracts. It could also affect the confidence that its customers,
suppliers or investors may have in its commercial operations.

 

o Disclosure would also result in damage to the business reputation, and
loss of confidence in HEE through the disclosure of sensitive
information pertaining to an agreed contract which was considered
confidential.

 

o Disclosure would be likely to deter potential bidders for future
contracts from competing and sharing commercially sensitive
information with us, which would negatively impact upon the quality
and quantity of Governments’ supplier base. This his could be
prejudicial to the achievement of maximum value for money for the
public purse in future competitions and contrary to the public
interest.

 

o HEE must retain commercial confidence of third party bidders when they
choose to engage in commercial activities with us. The release of this
information may jeopardise this commercial confidence.

 

In conclusion, HEE has determined that it is not in the public interest to
prejudice the commercial interests of the unsuccessful suppliers. As such
this information has been deemed exempt from disclosure under section
43(2) of the Act.

However, we are able to advise you as follows:

 

- A total of 12 bids were received.

- The successful bidder was The Lunniagh Partnership Ltd.

 

 

Q2 – Actual spend on this contract/framework (and any sub lots), from the
start of the contract to the current date

 

A2 - To date, the spend on this Contract has been £4,000.00.

 

 

Q3 – Start date & duration of framework

 

A3 – The Contract Term was 01/04/2021 to 31/03/2022.

 

 

Q4 – Is there an extension clause in the framework(s)/contract(s) and, if
so, the duration of the extension?

 

A4 - No extensions were included as part of this Award.

 

 

Q5a&b - Has a decision been made yet on whether the
framework(s)/contract(s) are being either extended or renewed? If yes,
when do you intend to publish the tender?

 

A5 - This contract will expire on 31/03/2022. It is not yet known if this
tender will be run for the next financial year or not.

 

 

Q6 -    Could you provide the tender documents for this contract?

 

A6 – Please refer to the attached documentation.

 

 

Q7 – Who is the senior officer (outside of procurement) responsible for
this contract?
