LBC Request : Hate Crime

We're waiting for Rachael Venables to read a recent response and update the status.

Dear West Midlands Police,

I wish to know details of all people who have been arrested for hate crime offences over the past five years.

Providing the following by each financial year (2013-14, 14-15, 15-16, 16-17, 17-18) can you list first :

- the arrested person's age
- then their gender
- the type of hate crime (race, religion, disability etc.)
- whether they were charged
- and, only if this is possible, any details you have available on the crime itself; whether online/in person, verbal / physical etc.

I wish to be informed in writing whether you have such information and, if so, I seek the disclosure of that information. If the information is covered by any exemptions, please disclose such information as is not covered by the exemptions.

If you are considering charging for the disclosure of this information, please inform me before any work that would be liable to a charge is carried out.

REQUEST

 

I wish to know details of all people who have been arrested for hate crime

RESPONSE

 

Our data are not organised in such a way as to allow us to provide this
information within the appropriate (cost) limit within the Freedom of
Information (FOI) Act (see ‘Reason for Decision’ below).

 

However rather than refusing your request outright at this stage, I would
like to explore with you how West Midlands Police may best assist you to
request relevant information which we hold. Within the cost limit we could
conduct the following searches:

 

For each financial year (2013/14, 2014/15, 2015/16, 2016/17, 2017/18):

The number of arrests with a flag to indicate the following: Faith,
Homophobic incident, Disability, Transphobia and Racist Incident, broken
down by:

Charge

The offender’s age

The offender’s gender

 

Please note that any located information might be subject to the
application of exemptions under the Act.

 

To enable us to proceed with your request I would be grateful if you could
confirm whether you wish us to undertake the search outlined above. After
receiving your reply, your request will be considered and you will receive
a response within the statutory timescale of 20 working days, as defined
by the Act, subject to the application of any statutory exemptions. If you
chose not to respond then your request will remain unanswered.

 

REASON FOR DECISION

 

Please note that we are unable to determine the details of the arrests
(whether online/in person, verbal / physical etc.) without examining each
individual case which would exceed the appropriate limit (FOIA, s.12).

 

This means that the cost of compliance with the whole of your request is
above the amount to which we are legally required to respond, i.e. the
cost of locating and retrieving the information would exceed the
appropriate costs limit under section 12(1) of the FOI Act 2000. For West
Midlands Police, the appropriate limit is set at £450, as prescribed by
the Freedom of Information and Data Protection (Appropriate Limit and
Fees) Regulations 2004, S.I. 3244.
