What lawful basis under GDPR 2018 is used by barrister's and chambers for processing data from individuals who have not given their explicit consent as a data subject.

Dear Mr Grant

 

The General Council of the Bar is not subject formally to the Freedom of
Information Act as we are not a public authority as outlined in Schedule 1
of the Act; however, we endeavour to respond to such requests within the
spirit of the Act, in the interests of transparency.

 

However, I cannot answer your question. For one thing, it would depend
what processing a barrister or chambers was doing to someone’s personal
data, and what data that was, to know what the lawful basis for processing
is. But, more importantly, the barrister or chambers is the data
controller – not the Bar Council – so you would need to ask them directly.
You should also be able to ascertain this information from the barrister’s
or chambers privacy notice.
