Freedom of Information Act 2000 – Information Request

 

Dear Ms Hemsley,

 

I am writing in response to your further request for information on the
Lauren Wright case. In our initial response to you we provided the
executive summary of this case on the grounds the information contained
within this report was already largely available in the public domain.
Your further request for the detailed report on the Lauren Wright case has
now been considered.  

 

In accordance with the provisions of the Freedom of Information Act 2000,
I have now processed your request. 

 

Your request has now been considered and is refused. In accordance with
the Freedom of Information Act 2000 this letter acts as a Refusal Notice.

 

Exemption Applied

 

Section 40(2) provides that any information to which a request for
information relates is also exempt information if-

 

a       it constitutes personal data [about a third party], and

b       either the first or the second condition is satisfied.

 

In this case the first condition applies which is:

 

a       in a case where the information falls within definition of data
under the Data Protection Act 1998, the disclosure of the information
would contravene

 

i.        any of the data protection principles or

ii.      Section 10 of the DPA (right to prevent processing likely to
cause damage or distress), and

 

b   In any other case, the disclosure of the information would contravene
any of the data protection principles if the exemptions in S33A(1) of DPA
were disregarded.

 

Reason why the exemption applies

 

This decision is based upon the following reasons: 

 

The report requested may hold information about third party individuals
who we do not have consent from to release their information into the
public domain.

 

In addition:

 

Norfolk County Council has a duty of confidentiality to all of its service
users and this duty extends beyond death.  In order to ensure that we do
not breach this duty of confidentiality we will not release personal data
relating to a deceased person into the public domain (as would be the case
if the information were released under the Freedom of Information Act.) 
Therefore, your request for information has now been considered and is
refused.  In accordance with the Freedom of Information Act 2000 this
letter acts as a Refusal Notice.

 

Exemption Applied

 

Section 41(1) of the Freedom of Information Act 2000 provides an absolute
exemption for release of information if the information was obtained by
the public authority from any other person (including another public
authority), and the disclosure of the information to the public (otherwise
than under this Act) by the public authority holding it would constitute a
breach of confidence actionable by that or any other person.
