Dear Housing and Property Chamber First-tier Tribunal for Scotland,

This relates to the involvement of The Housing and Property Chamber, First Tier Tribunal for Scotland in the case of Addiewell, Glasgow Road, Sanquhar, Dumfriesshire.

In this case, the criminal landlord, Michael Monk, failed to undertake works notified to him by the HPC. As as consequence, at a Hearing in September 2016, a Repairing Standard Enforcement Order was placed on the property. As at 9 February 2018, he had not complied with this. No action was taken against him for his failures.

At the same time, a landlord, called AM, was prosecuted for his failure to comply with an RSEO in the period May 2017- April 2018.

What was the reason for the failure to prosecute Michael Monk? Was Freemasonry a factor?

I am writing to request an internal review of Housing and Property Chamber First-tier Tribunal for Scotland's handling of my FOI request 'Landlord failing to comply with Repairing Standard Enforcement Order.'.

You state that cases may be referred to Police Scotland when a landlord fails to comply with an RSEO. It is then for Police Scotland to investigate matters and send the case to the COPFS. In the case of landlord "AM"
his failure to comply with the RSEO was clearly referred to Police Scotland. So, did the Housing and Property Chamber, First Tier Tribunal refer the case of criminal landlord Michael Monk's long term failure to comply with the RSEO to Police Scotland?

In the original request you were asked for the reason Monk wasn't prosecuted. Was this because the HPC, First Tier Tribunal for Scotland didn't refer this to Police Scotland? Wast Freemasonry a factor here?

This is typical of a corrupt body which fails to uphold the laws surrounding criminal landlords.

In this case, one Michael Monk, landlord of a property in Sanquhar, failed to undertake repairs, gas safety certificates and his duties as a landlord for years. A Repairing Standard Enforcement Order was placed on the property on 16 September 2016 and removed unlawfully (repairs had still not been undertaken) on 12 February 2018. Rather than act lawfully, the Housing and Property Chamber were biased towards the criminal landlord and acted against the interests of the tenant. There were many instances of their unlawful conduct in the time they were involved with this case. It is thought Freemasonry played a part in this. So, it can be said that criminal landlords are not subject to the law if they have the right handshake.
