Thank you for your information request of 03 February 2020 and please
accept our sincere apologies for delay in providing the response to you. 
Aberdeen City Council (ACC) has completed the necessary search for the
information requested. Our response is now detailed below.

 

How much was paid in landfill tax over the last three years?

2017:  £3,421,486.61

2018:  £1,582,199.68

2019:  £1,377,172.21

 

How much is spent diverting waste that would have been landing as landfill
waste over three years?

ACC’s Waste Strategy is directly aimed at avoiding landfill and since 2017
the bulk of the Council’s waste has been diverted with the exception of
those wastes not suited for other treatment types.  Therefore almost all
of the Council’s waste and recycling budget (approx. £20 million per
annum) is in some form aimed at diverting waste from landfill.  Please
note this budget includes collection, support, promotion, equipment,
supplies & services, staff costs, etc…

 

How much was generated by paper/cardboard and plastic waste collected over
three years?

ACC is not able to disclose the above required information as this is
commercially sensitive information.

 

ACC is unable to provide you with information on how much was generated by
paper/cardboard and plastic waste collected over three years as it is
excepted from disclosure. In order to comply with its obligations under
the terms of Regulation 13 of the EIRs, ACC hereby gives notice that we
are refusing this part of your request under the terms of Regulation
10(5)(e) – Confidentiality of Commercial or Industrial information - of
the EIRs.

 

In making this decision ACC considered the following points:

 

Whose commercial interests will be damaged by the release of the
information?

The commercial agreement covering the sale of recycled products through
the Waste Management Services Contract is between SUEZ Recycling and
Recovery UK Ltd and several third-party organisations. This contract
include a confidentiality clause covering commercial interests. Release of
this information will allow direct competitor organisations insight into
commercially sensitive arrangements. By releasing the agreement,
commercial competitors would have access to sensitive information and be
able to gain unfair advantage during the regular tendering process used to
arrange offtake agreements for sale of recycled products in the UK.
 Knowing the commercial rivalry between waste management companies, any
revelation of prices will undoubtedly cause reputational and commercial
harm.

 

Releasing this information to the public will not serve any interest other
than commercial interest. ACC recognises that there is a public interest
in being open and transparent about its public money and that disclosure
of this information may be in the public interest.

 

However, ACC is of the view that in this case, the public interest lies in
withholding the information as disclosure would prejudice ACC’s commercial
relationships and future contractual negotiations. Also, by breeching the
confidentiality clause in the Waste Management Contract, ACC would suffer
severe reputational damage and a loss of confidence by the current waste
Contractor and any future contractors. There is a strong public interest
in allowing normal market forces to operate in a competitive environment
and engage in a fair and transparent process. On this basis, ACC is of the
view that in all circumstances of the case, the public interest is best
met by applying Regulation 10(5)(e).

 

INFORMATION ABOUT THE HANDLING OF YOUR REQUEST

 

As the information which you requested is environmental information, as
defined under Regulation 2(1) of the Environmental Information (Scotland)
Regulations 2004 (the EIRs), we considered that it was exempt from release
through FOISA, and must therefore give you notice that we are refusing 
your request under Section 39(2) of FOISA (Freedom of Information
(Scotland) Act 2002).  However, you have a separate right to access the
information which you have requested under Regulation 5 of the EIRs, under
which we have handled your request. Please refer to the attached PDF for
