This is a formal request under the Freedom of Information Act 2000.
Could you please provide:

1) A complete list of all developed land that the college owns, including the postcode of each landholding.
2) A complete list of all the properties that the college owns, including the postcode and address of each property.
3) For each entry of land and property, the UPRN (Unique Property Reference Number)
4) For each property, the current use (e.g. student housing, retail, agricultural) and landholding status

If you are to invoke Section 43 to withhold information in relation to any of these questions please note you must provide details of the exact FOIA exemption, details of who would be prejudiced by this information, and a public interest test justifying a conclusion with arguments for and against the release of the information.

If you are to invoke Section 12 to withhold information in relation to any of these questions please provide details of how locating, retrieving and extracting this information would exceed the appropriate limit of £450 as set out in the Freedom of Information and Data Protection (Appropriate Limit and Fees) Regulations 2004. Please also be aware of your duty under section 16 (1) of the Act to advise and assist me in narrowing my request to bring it within the appropriate limit.

Further to your email of 7 December 2021, in response to your request
under the Freedom of Information Act 2000:

OUR RESPONSE

 

All the College’s property holdings are registered and are therefore
publicly available via the HM Land Registry.  The information is therefore
exempt from disclosure under Section 21 of the FOIA as it is
accessible to you by other means, as it is already in the public domain
(it can be obtained through a Land Registry Search).  To assist, please
find below a link to Land Registry Practice Guide 74.  This explains how a
search can be made against the Index of Proprietor’s Names by completing
form PN1 to show all property registered to a particular entity.

Dear Mr Cantrill,

Thank you for your reply and the links to student accommodation you have provided.

I am writing to request an internal review of this response. My reasons are as follows:
i) ICO guidance on Section 21 states that "There will be some cases where the fact that there is a charge for information may mean that it is not reasonably accessible to the applicant". My personal financial circumstances mean that land registry data is not 'reasonably accessible' to me, as there is a charge for each search against the Index of Proprietor’s Names on the database.
ii) ICO guidance states “If only part of the requested information is in the public domain, section 21 can only apply to that part of the request" - parts (3) and (4) of my request are not covered by the land registry data, as the land registry does not hold UPRNs and the information on land use is not complete and therefore I do not consider the use of section 21 for all four parts of my request appropriate.

I am writing to ask you to please review your response and reconsider providing this information in an accessible format.
