Dear Scarborough Borough Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Scarborough Borough Council's handling of my FOI request 'Land owned and managed by Scarborough Borough Council'.

It is unfortunate that according to Mark Robinson, Solicitor who I believe works for Scarborough Borough Council states the Council will not honour this freedom of information request.
The land a council owns and manages is fundamental knowledge that any voter, constituent or citizen might need and I am shocked that the Council does not publish it anyway.
As in all cases, there is no obligation to charge fees, and the public authority may decide to provide
the information free of charge.

Therefore Scarborough Borough Council at present has chosen to deny the release of the information purely for money when they could easily have released this information.

I ask Scarborough Borough Council to release the information in the spirit of transparency and democracy and taking into account the Nolan principles

Selflessness – Holders of public office should act solely in terms of the public interest. They should not do so in order to gain financial or other benefits for themselves, their family or their friends.
Integrity – Holders of public office should not place themselves under any financial or other obligation to outside individuals or organisations that might seek to influence them in the performance of their official duties.
Objectivity – In carrying out public business, including making public appointments, awarding contracts, or recommending individuals for rewards and benefits, holders of public office should make choices on merit.
Accountability – Holders of public office are accountable for their decisions and actions to the public and must submit themselves to whatever scrutiny is appropriate to their office.
Openness – Holders of public office should be as open as possible about all the decisions and actions they take. They should give reasons for their decisions and restrict information only when the wider public interest clearly demands.
Honesty – Holders of public office have a duty to declare any private interests relating to their public duties and to take steps to resolve any conflicts arising in a way that protects the public interest.

How long does an internal review take?

Dear FOI,

I have received no reply to my request for an internal review. Please could I receive not only a reply to that but under s16 FOI Act 2000 please may I receive advice and assistance on how to make my request within the £450 limit

Dear FOI,

From the non replies, and the de facto refusal to instigate a perfectly lawful request for an internal review it is perefectly obvious to people readind this that Scarborough Borough Council is a rogue council that quite deliberately breaks the law. As the council is made up of individuals it would therefore appear that the senior council members are corrupt if they choose not to comply with the law and reply to the foi request, the advice and assitance required under s16 and the internal review.
Further non reply of non legal compliance will confirm this, with no further action necessary
