Due to the proximity of the Kings Hill development to Coventry city rather than to any major towns in Warwick area, what interaction and Coordination is taking place between Warwick and Coventry council? Please include any financial compensation that Warwick is providing to Coventry.

Thank you for your request dated 3rd March 2020.

 

Please find our response detailed below.

 

In the first instance, I would like to provide some clarity and advise
that it is not for Warwick District Council to compensate Coventry City
Council in any way for this development.

 

As would be the case with any major planning application where a
development proposal of a certain scale  is being considered, it is for
the developer(s) to mitigate the impacts of that development by way of the
necessary financial contributions, and any other obligations that have
been identified as being necessary to make the development acceptable in
planning terms. Such contributions/obligations need to meet stringent
legal tests of reasonableness and soundness otherwise they should not be
sought in the first instance and providing they meet those tests, they
will be secured through a legal agreement (a Section 106 Agreement).

 

In this instance, both Warwick District Council and Coventry City Council
are parties to the S.106 Agreement, due to the sheer size and scale of the
development, and due to the fact that the site itself falls within Warwick
District but a lot of the impact will in fact be had on Coventry, not just
Warwick’s administrative boundary (a good example being the highway
network).

 

It will in fact, therefore, be the case that such mitigation and financial
contribution is paid to both Councils, not just Coventry City Council,
because the impact of a development this size will be felt on both
Warwick’s and Coventry’s infrastructure, including the highway network,
public transport, education and healthcare systems, to name just a few.

 

The Section 106 agreement will set out in very explicit terms precisely
what is paid to whom, for what purposes and what the triggers for payment
will be.

 

Warwick District Council (WDC) and Coventry City Council (CCC) are working
together on this application.  They have been continually for the past two
years since the planning application was first submitted to the WDC for
determination and this will continue to be case until the decision is
physically issued by WDC, which is the primary determining authority. Work
on the S.106 agreement is still ongoing and it is inevitable that there
will be cross-boundary working between the two authorities for such an
allocated site of this magnitude that affects both sides of the
administrative boundary.
