Dear Mr Chapman,

 

In response I can confirm that in Bristol Kingdom Services Group is
operating in accordance with DOE guidance as published at the link shared
in the information request.

 

Bristol City Council carries out enforcement of environmental crime in
alignment with enforcement guidance. When the offence of littering is
witnessed by an enforcement officer there then an FPN will be served on
the offender unless they are aware of any vulnerabilities. The officer has
no discretion on whether to serve an FPN on a non-vulnerable individual
who has committed the offence.

 

The relevant sections from the Environmental Service Specification are
below and the council Enforcement Policy is attached:

 

4.1 GENERAL OBLIGATIONS

 

4.1.1 The provider is to use a range of intelligence sources and data to
direct its resources effectively and efficiently.

 

4.1.2 The provider shall not (and shall procure its patrol officers shall
not) issue FPNs to anyone under the age of eighteen (18) years old unless
specifically authorised to do so in writing by the Mayor of Bristol or
their nominated delegated officer.

 

4.1.3 The provider shall not (and shall procure its patrol officers shall
not) issue FPNs to anyone who appears to lack capacity.

 

4.1.4 The provider shall not issue FPNs to anyone where the issuing of
such FPN shall (or is likely to) generate negative publicity for the
Council.

 

4.1.5 The provider shall ensure that any FPN that is issued is at a rate
that is in line with the Councils charges. The current Council Fixed
Penalty Notice charges are as set out in Appendix A of this document.

 

4.1.6 The provider must ensure patrol officers carry out personal ID
checks /enquiries of suspected offenders/offenders to ensure that they
have provided accurate identity details to reduce the risk of an
unsuccessful enforcement.

 

4.1.7 The provider must ensure that all Police and Criminal Evidence
(PACE) notebooks and any sensitive information collected on behalf of
Council are stored securely to comply with the Data Protection Act 1998.

 

4.1.8 The provider must ensure that no group with protected
characteristics under the Equality Act 2010 is disproportionally targeted
in the performance of this contract.

 

4.1.9 The provider must not assign, sub-let or transfer the benefit or
burden of the contract or any part of it except with the prior written
consent of the Council; which consent may be either withheld or given
subject to such conditions as the Council may think fit.

 

4.1.10 The provider shall make documentary returns as may be required by
the Council, including providing statistical data and written reports in
relation to any complaints or enquiries received relating to the services.

 

4.1.11 The provider shall provide and maintain suitable computerised
systems for the collection and storage of data and undertaking
administrative functions.

 

4.1.12 The provider shall provide, set up, operate and maintain a suitable
electronic payment system for offenders to discharge their liability.
Methods and mechanisms of payment are to be widely publicised in a range
of formats.

 

4.1.13 All correspondence relating to the performance of the services,
including complaints will be dealt with primarily by the provider and
responded to within ten (10) days of receipt. The provider shall be
required to deal with complaints, and carry out any required
investigations, in accordance with the Council’s Complaints Procedure; a
copy of which shall be provided to the successful provider. For all
correspondence which is answered by either the provider or the Council it
must be possible to re-create a letter as it was sent, to be incorporated
into a case file for the court.

 

4.1.14 The Council’s authorised representative shall be supplied a copy of
all correspondence received and/or sent by the provider in relation to the
services and/or the contract.

 

4.7 APPLICABLE SERVICE STANDARDS

 

4.7.1 The provider must comply with all Acts of Parliament relating to the
performance of the service generally. The provider shall comply with any
changes to legislation and any new legislation, procedures, regulations,
codes, guidance etc. which may be in force from time to time during the
contract.

 

4.7.2 Without prejudice to the generality of the provision in section
3.6.1 above, the provider must comply with the requirements of the
Equality Act 2010, the Regulation of Investigatory Powers Act 2000, the
Data Protection Act 1998 and co-operate with the Council with regard to
the Council’s duty to comply with the provisions of the Freedom of
Information Act 2000 and Environmental Information Regulations 2004.

 

Applicable local standards

 

4.7.3 The provider shall comply with Bristol City Council’s Commissioning,
Enforcement and Complaints policies as appropriate.

 

4.7.4 The provider must ensure that any surveillance techniques deployed
(directed surveillance, use/deployment of Covert Human Intelligence Source
(CHIS) and acquiring communications data (comms) are compliant with
Bristol City Council’s Regulation of Investigatory Powers Act (RIPA)
policy, the Council’s training guidance and relevant Home Office guidance
(both mandatory codes of practice and best practice guidance) and relevant
legislation.
