I'd like to submit a freedom of information request and ask if you could
kindly provide all information relating to communication (e.g. emails,
information about phone calls, meetings (including briefings or minutes))
with King's College London University on issues related to the company
Serco, and related contracts.

I am treating your correspondence as a request for information under the
Freedom of Information Act 2000 (FOIA).

The Ministry of Defence requires further information in order to determine
whether it holds information within the scope of your request. The term
'issues' can be interpreted broadly. Could you please clarify what you
mean by 'issues related to the company Serco'? Similarly, could you please
provide more detail on what 'related contracts' you are interested in?

When considering this you may find it helpful to note that as part of the
Joint Services Command Staff College (JSCSC) Private Finance Initiative
(PFI) contract with Defence Management (Watchfield) Ltd (DM(W)L), DM(W)L
sub-contract all services provided under this contract to Serco. Serco in
turn sub-contract KCL for the provision of military education to the
Defence Academy's JSCSC. This arrangement has been in place since the
College became operational in 2000.

We would also suggest specifying a timeframe for material in which you are
interested; as the two parties have provided services under these
contracts for over 20 years, there is potentially a significant amount of
material involved.

Accordingly, I should explain that Section 12 of the Act makes provision
for public authorities to refuse requests for information where the cost
of dealing with them would exceed the appropriate limit, which for central
government is set at £600. This represents the estimated cost of one
person spending 3.5 working days in determining whether the Department
holds the information, and locating, retrieving and extracting it. Noting
those limits outlined at Section 12, and the considerable period of time
in scope of your existing request, we would therefore recommend that you
refine the timeframe for material in which you are interested.

Once you have clarified your request, I will be pleased to consider it
again.

Thank you for your response. I had attempted to provide these clarifications in my latest communication with you as well as provide examples, and am disappointed to hear that they weren’t sufficient.
I have re-attempted to narrow and clarify my request (ref: FOI2021/09607).

In order to narrow and clarify what is meant by ‘issues’, I have further restricted my request to be concerned with communications explicitly concerned with contracts regarding military education to the Defence Academy's JSCSC, that you referred to in previous communication. -Limiting the request to contract documents and communication about the contracts within the time frames (and the respective priorities) I outlined previously would be appreciated.

I hope that you can take this communication as clarification (as per your request) rather than consider it as a new FOI, as appears to have been done with my last communication, as I initially submitted this in August 2021. It should be easy for FOI officers to identify whether or not requests are within the cost limit & scope/'untenable', and if not, should "provide advice and assistance" for the best way to find the information being requested (as per ICO guidance).

On the handling of requests that require clarification, it may be helpful
if I explain that ICO guidance stipulates that:

If the requester subsequently provides enough detail to enable

the authority to identify and locate the information, then the

authority must respond to the clarified request within a new 20

working day time limit with the 'clock' starting the day after it

receives the required clarification.

As such, when clarification is sought, the case is closed, with a new case
