Justification of 60 year student loan age limit vs. Equality Act 2010

Dear Student Loans Company Limited,

The provision of student loans for postgraduate education is restricted to those aged less than 60 on the first day of the first academic year of the course.

Such age discrimination is permitted under the Equality Act 2010 (2010 c.15), sch 3, pt 5, s 20A(2) “… only if the assessment of risk, so far as it involves a consideration of B's age, is carried out by reference to information which is relevant to the assessment of risk and from a source on which it is reasonable to rely.”

Please provide:

1. copies of such risk assessments citing the sources upon which they rely;
2. copies of all other evidence and/or assessments and/or information supporting the age limitation on postgraduate student loans;
3. statistics relating to the repayment of student loans eg. British vs. non-British, undergraduate vs. postgraduate students etc.;
4. copies of other risk assessments relating to the repayment of student loans.

I refer to your recent email dated 15^th November 2019 requesting the
following information under the Freedom of Information Act 2000 (“FOIA”):

Response

Questions 1 and 2
Student Loans Company Limited (“SLC”) administers the student finance
schemes in line with the statutory framework laid by, and policy guidance
of, the UK Government and Devolved Administrations.  Any risk, or other,
assessment for Equality Act 2010 purposes have not been undertaken by SLC,
rather the relevant policy maker/administration.  Accordingly, SLC does
not hold any information falling within the scope of these two questions.

By way of advice and assistance, postgraduate loans are available to
students across the four UK domiciles of England, Wales, Northern Ireland
and Scotland.  There is no age limit on postgraduate loans in Northern
Ireland, and SLC does not assess applications for students from Scotland,
therefore the information that in the paragraph below relates to England
and Wales only.  

A number of Equality Impact Assessments relating to postgraduate loans are
publicly available therefore technically exempt from disclosure under
section 21(1) of the FOIA as these are reasonably accessible to you by

It is not clear exactly what statistics you are requesting, therefore we

 The June 2019 SPs for England and Wales separate undergraduate loans and
postgraduate loans, as well as English domiciled borrowers and EU
domiciled borrowers.

Question 4
As stated in our response to questions 1 and 2, the relevant policy maker,
not SLC, would undertake any risk assessments required for the purposes of
the Equality Act 2010, and your question would be more appropriately
directed to the relevant policy maker/administration.  A number of
