July 2019 - Discretionary Deferral Funding & Early Entry to School Data

Dear Dundee City Council,

Please accept this email as a Freedom of Information request.
Please could the Council provide:

(For Qs 1-3 below this data was already requested in an FoI by Sarah McCluckie via the WDTK website in early May so I am looking for either confirmation that your response to that FoI is still accurate or an update on the data if there have been any subsequent applications and decisions).

1) The total number of requests received to date for the Council to provide discretionary funding for a further year of early learning and childcare for children whose fifth birthdays will fall between the day after the school start date in August 2019 and 31st Dec 2019.

2) A breakdown of the total number in 1. above by requests for
a) continued funding in private/voluntary settings and
b) continued funding in council run settings.

3) In relation to question 2, please provide the number of places the Council has agreed to provide continued funding for in
a) private/voluntary settings and
b) council run settings.

4. How many of the children applying have a December birthday?

5a. How many appeals (challenges if there is no official appeals process) did the Council receive against the Council’s decision not to grant funding?

5b. How many of these appeals/challenges resulted in the initial decision being overturned?

6. How many official complaints has the Council received regarding discretionary deferral funding decisions between Nov 2018 and today?

7a. How many applications did the Council receive for children to be permitted early entry to primary school to start in Aug 2019 instead of Aug 2020 (for children who will turn five on or after 1st March 2020)?

7b. How many of these early entry applications were approved?

8. Is the Council’s discretionary deferral funding policy currently under review or are there any plans to update it in the near future?

Thank you for your response to my FoI request of 18/7/19. You stated under Q3 that the data from the previous FoI sent in May this year was still correct. My understanding from this is that all 45 requests received had been granted funding. However, it has been brought to my attention that at least one request was refused for a late-autumn born child to receive continued EL&C funding from the Council for session 2019-2020. Could the numbers be double-checked?

The Legal Manager’s response

 

On 12 August 2019 the Legal Manager responded to your request by
confirming that for questions 1-3 there was no change from the previous
FOISA. For Question 4, the answer was 20, for question 5 the answer was
that there were no appeals, for question 6, no complaints were received.
The answer to both parts of questions 7 was none and the answer to
question 8 was that there was a current review with neighbouring Councils
and funding of cross-boundary children.

 

 

Your request for review

 

On 15 August 2019 you responded stating that with regards to question 3,
you were aware of one instance where a request was refused and you
requested that the numbers be clarified.

 

The Freedom of Information Liaison Officer clarified that the correct
information was provided for question 3.

 

On 8 September 2019 you emailed again informing that you were aware that
in fact only 42 applications were approved and you again requested that
the information we had provided be checked.

 

The Legal Manager’s response to your request for review

 

I have discussed with the Legal Manager your position and he has responded
as follows:-

 

Having again reviewed your request and rechecked the information it has
become apparent that in May 2019 42 applications were approved.  Please
find attached an amended response along with the most up to date position.

 

My Conclusion

 

I hope that the information provided to you satisfies your request.

 

If you are unhappy with my decision, you may appeal to the Scottish
Information Commissioner.  You must submit your appeal to the Scottish
Information Commissioner within six months of receiving my decision.
