Information Request 6750540 Joint Protocol for river
management/enforcement

I write following your request for an internal review, and to apologise
for the fact that you have not yet received a response to your request. It
has been necessary for officers to consult with Broadland District
Council; however this does not excuse the time taken thus far. There are
some concerns about disclosure of the document in question and we are
working through these concerns to establish the extent to which the
information contained within the document should be disclosed.

Dear  P Smith

Freedom of information request - process number  6750540

Further to recent email communications please now find attached a copy of
the river management/enforcement protocol, which has been slightly
redacted for the reasons stated below.

It is fully acknowledged that the council did not meet the required
statutory timeframe for response ; however it was necessary to consult
with the Broads Authority and to further review the council's own concerns
regarding the status of the information within the protocol document. As a
consequence a decision has been reached which now results in the protocol
being disclosed to a significantly greater extent than originally
envisaged.

It is the Council's view that the information within the protocol
constitutes environmental information, and so its status has been
considered under the Environmental Information Regulations 2004. Whilst
the majority of the information is now disclosed to you, a small amount of
redaction has been made where it is deemed likely that the publication of
that information would undermine the effectiveness of river
management/enforcement, and thereby also put the river environment itself
at risk.

This small amount of information is withheld under the following two
exceptions to disclosure provided by the Environmental Information
Regulations:

Regulation 12(5)(b) - The course of justice, the ability of a person to
receive a fair trial or the ability of the public authority to conduct an
inquiry of a criminal or disciplinary nature

Regulation 12(5)(g) - The protection of the environment to which the
information relates

It is the Council's view that any public interest in the redacted
information is far outweighed by the need to maintain effective river
management and enforcement activities, and to protect the river
environment.
