You have removed a poster, which states “I love JK Rowling” situated at Edinburgh Waverley Station. This was removed as a result of a campaign by those opposed to women who speak out about their rights.

Dear Mrs Tevendale

Thank you for your email. I note you have asked for an internal review of your request - as the Head of FOI this will come to me to deal with - however, I was in the course of writing to you tonight and can advise you of several relevant points in my response now. You are welcome to consider these and see if you then wish to go ahead with the internal review.

I was writing to you to advise that we will not be able to response to your request within the deadline, which is today, 29th September 2020.

We wrote to you on 20th September 2020 advising that the initial 20 day deadline was being extended in accordance with the provisions of the FOI Act for consideration of the public interest in respect of the section 43(2) exemption. That deadline expires today, and I can advise that these considerations have been completed; while we believe that certain information should continue to be withheld under section 43(2), we are now preparing a substantial disclosure for you.

We are in the process of conducting a final review of the information that will be disclosed - this is to ensure that all personal information is correctly removed under the section 40(2) exemption for personal information, prior to public disclosure. We are working to provide this to you within the next 5 working days. I acknowledge that this constitutes a breach of section 10(1) of the FOI Act, and I offer you my apologies for this.

We will be in touch again with the substantive response as soon as the disclosure is checked and finalised. You are welcome to contact me if you wish me to issue this in a formal internal review decision, or if you wish to discuss any of the above.
