Thank you for your requests for information about hospitality and gifts
offered by Jeff and Cathy Nash to the local authority’s elected
councillors, bids for land submitted to the local authority by them or
their companies, and copies of any email correspondence between them or
their companies and elected councillors, between 2017 and 2020.

 

Under section 12 of the Act a local authority is able to aggregate
requests in the following circumstances:

 

·         two or more requests for information have been made to the same
public authority

·         they must be either from the same person, or from 'different
persons who appear to the public authority to be acting in concert or in
pursuance of a campaign'

·         the requests must relate to the same or similar information

·         they must have been received by the public authority within a
space of 60 consecutive working days

 

The local authority considers that your 2 requests fall into this category
and they will therefore be aggregated into 1 request.

 

Your request was received by the Information Rights Team on 03 August
2020.  This is being dealt with under the terms of the appropriate
Information Rights legislation.

 

In some circumstances we may charge for information.  If there is a charge
we will let you know, as you will have to pay it before we deal with your
request.

 

Some information does not have to be released under this legislation.  We

Your request for information ref. SOT90649 about gifts, hospitality and
meetings relating to elected councillors and Mr Jeff and Mrs Cathy Nash,
together with any emails between elected councillors and Mr & Mrs Nash or
their companies Potbank and Dog and Bone Projects, between 2017 and 2020

 

We have now considered your request. Please accept our apologies for the
delay in sending this response to you.

 

The information we are able to provide is attached and below. Please note
that some of the information is exempt under sections 40, 41 and 43 of the
Act and cannot be provided.

 

Section 40(2) (personal information) allows a public authority to withhold
information if its release would contravene the principles of the Data
Protection Act. This exemption has been applied to junior local authority
officer names contained within the attached documents. This is because
these junior officers have no influence any strategic decisions the local
authority may make and therefore would not expect their names to be
released into the public domain. The exemption has also been applied to
information contained in the documents which are the opinions and feelings
of individuals. Such opinions and feelings are considered personal
information, belonging to those individuals and not for releasing into the
public domain.

 

Section 41(1)(b) (information provided in confidence) allows a public
authority to withhold information if its release would constitute a breach
of confidence actionable by any person. This exemption has been applied to
small amounts of information contained within the attached documents
because the release of the information is prohibited by another enactment
of law and would result in action being taken against the local authority
if the information was released. The local authority does not consider it
in the public interest to release information into the public domain if
its release would have such repercussions.

 

Section 43(2) (commercial interests) allows a public authority to withhold
information if its release would, or would be likely to, prejudice the
commercial interests of any individual. This exemption has been applied to
information contained within the attached documents which contains very
detailed business plans belonging to individuals and companies. The
exemption has been applied because the local authority does not consider
it appropriate to release another person’s or company’s future business
development plans into the public domain where it would be available for
competitors to view. In order to achieve the best value for the public
realm and protect the credibility of decision-making processes, the local
authority considers that it is not in the public interest to release
information which could have a negative impact on these matters. In
addition, it could damage the essential trust between the local authority
and its potential partners if those partners feel that they are not able
to confidentially obtain advice from the local authority.

 

The information supplied may be used for domestic or journalistic
purposes. Its use for commercial gain including issuing to the public,
social media or computer blogs may be subject to the issue of a licence
under the Reuse of Public Sector Information Regulations 2015.
