JCIO refuses to deal with complaint against Bournemouth Court judge so, deliberately frustrates it.

We're waiting for bert to read a recent response and update the status.

Dear Ministry of Justice,

This is not a new query: due to technical problems at my end, I've had to open a new query so, this is a continuation of a previous query entitled: JCIO Refuses to Deal with Complaint Against Bournemouth Court judge - 30 December 2017.

I've copied the whole original query below and a full history of the original request and correspondence are available on the Internet at this address: https://www.whatdotheyknow.com/request/j....

Please accept my apologies for any inconvenience.

So, from the last comms of 24 September 2018:

I am writing to request an internal review of Ministry of Justice's handling of my FOI request 'JCIO Refuses to Deal with Complaint Against Bournemouth Court judge' because:

the MOJ demonstrates it has no intentions of addressing a simple FOI query preferring to come up with excuses. The MOJ is obliged under the same Act (it twice quotes) to assist me as it is able (check Section 16); there's no evidence it does so or indeed wishes to do so.

Here's my original query again:

..30 December 2017 (reworded June 2018)
Dear Secretary of State for Justice,
Subject: JCIO refuses to deal with complaint against Bournemouth Court judge. In doing so, it deliberately frustrates the complaint, effectively trashing it.
The OJC does not wish to deal with my complaint against JCIO so, I turn to the Secretary of State.
Would you kindly identify any recorded information (for example, a policy paper) which highlights the Secretary of State's responsibilities when the designed processes of complaint fail or offer no remedy..

With respect: would someone other than the same person/s thus far handling my query kindly offer a response.

Regards
Bert

Dear Sir or Madam,
Please note, under section 8(1) of FOIA, a request for information must comply with three requirements. It must:
(a) be in writing,
(b) state the name of the applicant and an address for correspondence, and
(c) describes the information requested.
After initial consideration, this request appears to comply with requirements (a) and (c) but it does not comply with requirement (b) because you have not provided your full name.
I am therefore not required to process your request without information that can later be referred to, as per Section 8(1)(b) FOIA. The information we require is your name.
As your request has been deemed invalid, I am not obliged to disclose the requested information at this point and I would like to take this opportunity to recommend that any future FOI submissions adhere to Section 8 of the FOIA.

Disclosure Team, Ministry of Justice

Thank you for your e-mail, I am writing to advise you that your enquiry does not fall under the Freedom of Information Act 2000 (FOIA) regime and has been rejected by the Disclosure Team.

It may be helpful if I explain that the FOIA gives individuals and organisations the right of access to all types of recorded information held, at the time the request is received, by public authorities such as the Ministry of Justice (MoJ). Section 84 of the FOIA states that in order for a request for information to be handled as a FOI request, it must be for recorded information.

For example, a FOI request would be for a copy of a policy, rather than an explanation as to why we have that policy in place. On occasion, the MoJ receives requests that do not ask for recorded information, but ask more general questions about, for example, a policy, opinion or a decision.

You may wish to re-submit your enquiry to the Ministry of Justice, which will be treated as Official Correspondence. Our contact details are as follows:

Dear Ministry of Justice,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Ministry of Justice's handling of my FOI request 'JCIO refuses to deal with complaint against Bournemouth Court judge so, deliberately frustrates it.'.

Thank you for your message.

The FOIA states that in order for a request for information to be handled as a FOI request, it must be for recorded information so, would you handle the following request for recorded information accordingly:

Background: JCIO refuses to deal with complaint against a judge. In doing so, it deliberately frustrates the complaint, effectively trashing it. The OJC does not wish to deal with my complaint against JCIO so, I turn to the Secretary of State.

Here's the query: would you kindly identify any recorded information (for example, a policy paper or other document) which highlights [that's to say recorded information which identifies] the Secretary of State's responsibility when the designed processes of complaint [identified above] fail or offer no remedy. [I do not seek opinion]

Again I'd remind you: according to Section 16 of the FOI Act, something with which you admit familiarity, you are obliged to offer advice and assistance; thus far something you fail to do despite your duty. It's unclear why you offer me to contact you given that you fail even to respond to this simple query.

Please note: your response, that you care to offer one, should be submitted without prejudice. Kindly confirm you understand what this means.

Dear Ministry of Justice,

Subject: JCIO refuses to deal with complaint against a Bournemouth Court judge. In doing so, it deliberately frustrates the complaint, effectively trashing it.

Thanks for your message and apologies for failing to supply all the details sought however, I fear it would be of little use were I to do so. So, would you kindly pass this on to the person who conducts Freedom of Information reviews. I am writing to request an internal review of Ministry of Justice's handling of my FOI request 'JCIO refuses to deal with complaint against Bournemouth Court judge so, deliberately frustrates it.'.

Outside the Act, and according to Section 16 of the Act, you're are expected to offer advice and assistance. So, accordingly I ask: are you prepared to deal with my query as a general one. It is after all a simple request:

JCIO refuses to deal with a complaint against a Bournemouth Court judge. In doing so, it deliberately frustrates the complaint, effectively trashing it. The OJC don't wish to deal with my complaint against JCIO so, where does one turn? is the SOS able to intervene?
