Dear Home Office,

I am requesting via the Freedom of Information Act access to the entirety of all/any information and documents relating to all contact between the Home Secretary, Jack Straw and Northumbria Police concerning the June 1999 Martin McGartland attempted murder case.

1. Copies of all correspondence between Jack Straw and Northumbria Police, including all any contact by his office and/or any other third parties acting on his behalf concerning the above case.

2. Copies of all correspondence between Jack Straw, his office and any Member of Parliament and or Lord(s) concerning above case.

3. Copies of all information, records relating to all/any telephone contact between Jack Straw, his office and Northumbria Police concerning above case.

4. Full details of any meetings that Jack Straw held, and/or attended concerning Martin McGartland case, his attempted murder. Please supply all dates and reasons/s for all/any meetings.

In your 16-09-2011 reply you wrote, 'Further to my letter of 11 August regarding your request for all information and documents relating to all contact between the Home Secretary, Jack Straw and Northumbria Police concerning the June 1999 Martin McGartland
attempted murder case.' There is no letter from you dated 11th August 2011 concerning this request. Please can you add, attach the letter to this resust, where it should have been added. It seems to me that the Home office are simply playing for time and delaying this request.

I first asked for this information on 14th July 2011. Your reply of 16th September 2011 is the first and only reply I have been sent by you to this request, the above correspondence. confirms this is the case.

I am not at all happy by the way in which you are dealing with this request. You have already breaced the act in a number of ways and you are continuing to do so. Please dealt with this request and stop delaying and covering-up the attempted murder of a British Agent, stop protecting IRA terrorists.

I see that the ICO has already stated this regards Home Office; (75. 'During the course of his investigation, the Commissioner has encountered considerable delay on account of the Home Office's reluctance to meet the timescales for response set out in his letters. The delays were such that the Commissioner found it necessary to issue an Information Notice in order to obtain details relevant to his investigation. 76. Accordingly, the Commissioner does not consider the Home Office's approach to this case to be particularly co-operative, or within the spirit of the Act. Marty McGartland is single-handedly responsible for stopping at least 45 IRA bomb and assassination plots: http://politics.caledonianmercury.com/20... he saved the lives of at least fifty people and he put his own life in danger while doing so. As a result, the IRA kidnapped Martin 8th August 1991, Marty escaped certain death by jumping from a third floor window. Marty was also shot at least 6 times by the IRA in June 1999, the IRA only found Marty's safe house after MI5, Northumbria Police and the CPS took a flawed and malicious prosecution against him, he was acquitted. However, during the court case Northumbria Police read out Martin's real name and even his home address. Marty's 1991 kidnapping has also been covered up for the past 20 years, The State (including RUC and PSNI) suppressed compelling evidence, evidence that would have resulted in his kidnappers being charged, the men were not even arrested, they were protected by the State for 18 years (until Marty make another complaint); http://www.scribd.com/doc/55567240/Top-P...

This is a total disgrace, it is also wrong, it is a State cover-up. Marty McGartland is in very poor health as a result, the State cover-up has and continues to exacerbate this. The protecting of IRA terrorists and the covering-up of both Marty’s kidnapping and his 1999 attempted murder by the above parties has now gone on for between 12 and 20 years. The above parties are hell bent on protecting IRA terrorists who were involved with both attacks. The above parties are also using every trick in the book, and many more, to cover up their own wrongdoing.

This is not the first time the British State have used the ‘National security’ tactic as an excuse for not giving a full response to controversial questions and allegations concerning their dealings with the 1999 attempted murder of ex- British agent Martin McGartland. Thank you for your email of 15 November 2011 regarding your request for an
internal review. I apologise for the delay in responding to your request.
We are still considering the accuracy of the initial response.

 

On 8 November 2011 I sent you an email explaining the delay in responding
and providing a new deadline of 25 November 2011.

 

While the Information Commissioner’s guidelines suggest a 20 day deadline
for responding to internal reviews we are not legally bound to respond
within that deadline.

Dear FOI Responses,

You are incorrect, you are also breaking the law i.e. section 45 of the Code states that; "A one-stage review should be completed in 20 working days. In exceptional cases it may be appropriate to take longer but even in those cases it should not exceed 40 working days."

This is NOT an 'exceptional' case. The ICO further states; "The FOIA does not stipulate a time limit for completion of an internal review, but the section 45 Code states that they should be dealt with in a reasonable timeframe. The Information Commissioner’s view is that a reasonable time for completing an internal review is 20 working days from the date of the request for review. Please refer to the ICO’s guidance: Time limits on carrying out internal reviews

The Home Office have not dealt with this request within the 20 nor even the 40 working day limit. The Commissioner's Officer is very clear, "even in those cases it should not exceed 40 working days."

I am one of the Staffordshire Pindown child abuse victims and Jack Straw was one of those I appealed to when he took over from Lord Falconer at the Ministry of Justice. I wanted to know why I was being persecuted in the Secret Family Courts, it went on for 7 years and at one point I was kept against my will by my own legal team - who had been appointed without my consent by my solicitor Murray Cantlay, and two lawyers tried to force me, with threats, to sign documents against my will, I was illegally kept in a room by them for 2 hours at Stafford Crown Court. Jack Straw knew all this and did nothing, and Stafford Police did nothing, and I have also had my computer and mobile telephone hacked and had strange cars parked up outside my house.

Jack Straw and other MOJ ministers have a lot of questions to answer, because the Anti Terrorism powers have been, and are still being used on all sorts of people who are CLEARLY not terrorists at all.

Theresa May MP, Home Secretary (http://www.tmay.co.uk/) has claimed in a written, signed statement (dated 12-02-2014) to the High court in London that she can not confirm or deny that Martin McGartland was an agent. However, the Home office, Jack Straw, Home office solicitors have already done so, both in public (press release), in correspondence and by speaking to the media about the Martin McGartland. Martin McGartland says; "The reason why Theresa May MP, Home Secretary and MI5 are now misleading public, Court is in a desperate attempt to try to get a Judge, court to agree to a CMP aka Secret hearing. I say this is because Theresa May MP, Home Secretary, MI5 and HMG want to cover-up their own wrongdoing and corruption while dealing with my (Martin McGartland case)."

The Home Office and Jack Straw have already confirmed a number of times that Martin McGartland had been an agent.

Why is the Home Office and even a Government Minister now misleading the Court and the public by now claiming they can not confirm or deny that Marin McGartland was, had been a Spy, agent. The above evidence, penned by themselves, proves they have already confirmed he was, they have done so many times both in public and also in written correspondence.
