Gambling Commission did not have the information requested.

Dear Gambling Commission,
I am submitting a FOI request to find out as to how many written entries for ITV competitions have ever won a prize since the start of these competitions
I have always been concerned that although the competitions are open for written entrants they do not contribute any money for their entry, which would not benefit the organisers of the competition This is in contrast to the charges made to people who phone in which could be seen as discrimination

Thank you for your requests under the Freedom of Information Act 2000.

 

In relation to your request regarding  the number of Lotto Lucky Dips
which have been awarded to winners which have won any monies since their
introduction.  Having completed a check of our records, I can confirm that
the Commission does not hold this information therefor unfortunately we
are unable to help you with this request.

 

The Commission is responsible for licensing and regulating the National
Lottery, ensuring the interests of participants are protected and
maximising returns for Good Causes, we do not collect details on
individual winners as a matter of course.  This information is processed
by Camelot as the operator of the National Lottery but it is not
information we are required to collect in support of our regulatory
functions. 

 

With regards to your second request relating to written to entries for ITV
competitions. 

 

The competitions run on ITV fall within the category of prize competitions
or free draws which are  free of statutory regulatory control under the
Gambling Act 2005 and as such are not regulated by the Gambling
Commission. 

 

The Gambling Commission does monitor the boundary between lotteries,
competitions and free draws to ensure that organisers are appropriately
licenced. However as long as it can be established that the section 14(5)
test of the Gambling Act 2005 is satisfied showing that success depends,
at least in part, on the exercise of skill, judgment or knowledge by the
participants this will fall outside the authority of the Gambling
Commission. Therefor we are unable to assist with this element of your
request.

Review of the decision

 

If you are unhappy with the service you have received in relation to your

Dear Gambling Commission,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Gambling Commission's handling of my FOI request 'ITV Competitions and national lottery Lucky Dips awarded to winners.

I have read with interest your reply which has left me even more confused. You state that The Commision is responsible for licensing and regulating to ensure that the interests of participants are protected, but fail to answer my concerns raised that I have issues which may not be in the best interests of participants.
As I have already mentioned in my oridginal FOI there are no statistics to show or indeed protect participants from ITV or Camelot. As a regulator this should be a major concern to the commission, who should take on board my concerns and investigate.
As a gambling Commision set up to regulate and protect 'punters' how can you allow the ITV and Camelot to regulate themselves ? This would be a nonsense which would leave the public at high risk of exploitation from body's that you are paid to regulate
I am therefore requesting that you provide answers to the issues I raise as it remains my opinion that you are the regulator responsible

In one of the replies from your dept I was informed that your organisation was to regulate gaming? You were informed that the Commission regulates the National Lottery in my
letter dated 9 March 2017, attached to my email of the same date. I have
attached a copy of this letter to this email for your information. 
Unfortunately, the Commission does not hold copies of all of the
information that Camelot generates, nor do we collect details on
individual winners as a matter of course.

 

The Commission does not regulate the provision of prize competitions and
free prize draws; they are not gambling products as defined in the
Gambling Act 2005. As a consequence we do not hold the information you
requested. [1]Ofcom may be able to provide you with some guidance on prize
competitions and free prize draws offered by broadcasters; section two of
their Broadcasting Code outlines requirements that broadcasters must
adhere to when offering competitions (broadcast competitions).
