Some information with regard to the structure of Arden and GEM CSU is
available on the Cabinet Office website. NHS England holds this
information. As such, we will under Section 21 of the FOI Act (information
accessible to the applicant by other means) refer you to the published

The remaining information is being withheld under section 43(2) of the
Freedom of Information Act.
“Information is exempt information if its disclosure under this Act would,
or would be likely to, prejudice the commercial interests of any person
(including the public authority holding it)”
The Information Commissioner’s relevant guidance states that:
“…a commercial interest relates to a person’s ability to participate
competitively in a commercial activity, i.e. the purchase and sale of
goods or services’’
The Commissioning Support Unit (CSU) operates within a commercial
environment, competing with other CSUs and other organisations in the
provision of services to clinical commissioners.
The CSU’s commercial interests would be likely to be prejudiced if this
information is disclosed. This information would allow competitors to
calculate the cost of providing Information Governance services, which
would impact the ability of the CSU to compete in the market.
Section 43 is a prejudice based exemption and, as such, we are required to
assess both the prejudice test and the public interest test in withholding
this information against that of its release.
We recognise the importance of openness and transparency especially where
this relates to how public services are delivered. However, in this case
release of the information would create unfair market conditions as
competitors would have access to information regarding Arden and GEM CSU,
but the CSU would not have similar information about their competitors.
Further, we consider that the names and contact information of staff,
except for those in Very Senior Manager (or equivalent) positions, is
exempt under Section 40(2) of the Freedom of Information Act, which
provides that personal data about third parties is exempt information if
one of the conditions set out in section 40(3) is satisfied. Under the FOI
Act disclosure of this information would breach the fair processing
principle contained in the Data Protection Act (DPA), where it would be
unfair to that person. Section 40(2) is an absolute exemption and
therefore not subject to the public interest test when considering
disclosure of information.
