I write in connection with your request for information dated 7th December 2020 and received by this office on that date. Below are the questions raised in your request and all of the information we have been able to retrieve.

Please provide the following information, separated into years commencing 01.01.2010 up to the latest available records. All Domestic Violence Protection Notices or Orders issued by the Cleveland Police.

To clarify,
“issued to” = alleged victim
“against” = alleged perpetrator.

Section 1 of the Freedom of Information Act 2000 (FOIA) places two duties on public authorities. Unless exemptions apply, the first duty at Section 1 (1) (a) is to confirm or deny whether the information specified in a request is held. The second duty at Sec 1(1) (b) is to disclose information that has been confirmed as being held. Where exemptions are relied upon s17 of FOIA requires that we provide the applicant with a notice which: a) states that fact b) specifies the exemption(s) in question and c) states (if that would not otherwise be apparent) why the exemption applies.

Having made enquiries regarding your request we have been advised that for the current year alone there were 124 Domestic Violence Protection Notices or Orders. At our request the officer who looked for the data carried out a dip sample to estimate how long it would take to extract the data, the retrieval and collation in relation to 5 records took 4 hours and therefore it is estimated that 2020 records alone would take in excess of the appropriate time stipulated by the Secretary for Constitutional Affairs, Lord Falconer on the 18th Of October 2004, that is, eighteen hours. This falls under the exemption of 'Compliance exceeding the appropriate limit' covered by Section 12 (1) of the Freedom of Information Act 2000 and as such this work could not be undertaken.
Therefore, please treat this as a refusal notice under S17 of the Freedom of Information Act.
We would normally suggest that you refine your request and advise how but even a single year would be prohibitive.

Please note any statistical data supplied in relation to Freedom of Information requests is a snapshot of data held at the time the request was received by the Freedom of Information office and is subject to constant change/updates.

The Cleveland Police response to your request is unique and it should be noted that Police Forces do not use generic systems or identical procedures to capture and record data therefore responses from Cleveland Police should not be used as a comparison with any other force response you receive.

If you are not satisfied with this response or any actions taken in dealing with your request you have the right to request an independent internal review of your case under our review procedure. The APP College of Policing guidance states that a request for internal review should be made within 20 working days of the date on this response or 40 working days if extenuating circumstances to account for the delay can be evidenced.

We have made every effort to ensure a response was provided within statutory deadlines, however due to current circumstances delays have been unavoidable. Dear Cleveland Police,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Cleveland Police's handling of my FOI request 'Issuance of Domestic Violence Protection Notices and Orders'.

I have submitted identical requests to a number of other forces, so far I have 4 completed responses with all the requested data, all of those forces cover a larger population. I have received one refusal along the lines of your own, they state it takes 5 minutes per record, where as it appears to take almost an hour per record in your force, I find that to be severely lacking in credibility, and so it appears that the force simply does not wish to disclose the information and is unreasonably using this exemption clause illegitimately.

I have been requested to carry out an internal review of Cleveland
Police’s response to your FOI request.

 

By request dated 7^th December 2020 you raised the following questions:

To clarify,

Your request was refused by the Freedom of Information Decision Maker as
she found that the information was exempt by virtue of Section 12 (1) of
the Freedom of Information Act 2000.

I have reviewed your request and it is my determination that the
information is exempt by virtue of Section 12(1) of the Freedom of
Information Act 2000. As advised by the Freedom of Information Decision
Maker, there are 124 records for 2020 alone and retrieval and collation in
relation to 5 records took 4 hours. This time is calculated to include the
time taken to determine if the information is held, locate the relevant
information, retrieve the information and extract the relevant information
from the records. Therefore the records for 2020 would exceed the
appropriate time limit stipulated by the Secretary of Constitutional
Affairs, Lord Faulkner, namely eighteen hours.

 

Please be aware that each Police Force may use different systems and
procedures in order to record data therefore responses from different
forces may vary and should not be used as a comparison.

Please treat this as a refusal notice under Section 17 of the Freedom of
Information Act 2000.
