We are writing with regard to your recent request for information under
the Freedom of Information (FOI) Act 2000.

 

We will require clarification before we are able to identify and locate
the information you are seeking.

 

Your request:

Assistance provided under Section 16 (duty to assist):

 

The Trust has a responsibility under section 16 of the Act to provide
assistance with FOI requests where possible and reasonable to do so.

 

Due to system limitations and the coding available to us, the Trust can
only report on the number of infusions administered if the patient was
admitted specifically for it, but not if it was given during an inpatient
stay. However, our available data would not be specific to
iron/ferinject/monofer, it would cover therapeutic infusions of any kind.

 

Additionally, we would not be able to report information for questions 3 &
4 of your request on the basis that such information would only be
recorded within the individual patient records.  The only way in which we
could begin to compile this information would require the manual audit of
a large number of patient files, therefore this information could not be
provided within the ‘appropriate limit’ as specified in the Fees
Regulations and governed by section 12 exemption [cost limit]. 

 

In view of this, we are writing to provide you with the opportunity to
revise your request and indicate whether you still require the information
we are able to provide.

 

 

Please note that the 20 working day clock associated with FOI requests
will restart once we have received a response from you.

We required clarification regarding your request which was sent to you on
19 February 2020, to which you replied on the same day.  Under FOIA
legislation the clock stops when clarification is requested and is reset

Our response:

 

Under Section 1(1)(a) of the Freedom of Information Act (FOIA), the Trust
can confirm that it holds information relevant to your request and this
has been provided where possible below.

 

1 – 2. There were 3,029 episodes of care in 2019 (Jan – Dec) that were
given the code X292 (continuous intravenous infusion of therapeutic
substance). This relates to infusion of any substance, and wouldn’t be
specific to iron; it covers a therapeutic infusion of any kind.

 

3 – 4. The Trust does not currently collect or hold a central record of
this activity.  Any attempt to compile data in the format you are seeking,
would require the manual audit of all relevant patient records which would
require an unreasonable level of staff resources to complete.  We are
therefore unable to provide the information you are seeking within the
‘appropriate limit’ as outlined in the Fees Regulations and are engaging
section 12 exemption (cost limit) at this time.  We regret that the Trust
does not have the spare capacity to carry out this work. 

 

Brighton and Sussex University Hospitals NHS Trust has studied the work
involved in processing your requests for information and has estimated
that the cost of complying with this would exceed the appropriate limit as
set out in the Freedom of Information and Data Protection (Appropriate
Limit and Fees) Regulations 2004. The limit set down by the regulations
for public authorities is £450, which amounts to a maximum of 18 hours of
search and retrieval time charged at £25.00 per hour, the hourly rate also
specified in the regulations.

 

BSUH NHS Trust considers that it would take in excess of 18 hours to
retrieve and extract the information in the format that you have
requested.  Subsequently, it would cost the Trust more than £450, the
limit specified in the regulations. Under section 12 of the Freedom of
Information Act, BSUH NHS Trust is therefore not obliged to provide the
information that you have requested.

 

5. The Trust does not have a dedicated Iron Infusion Clinic. In EACU
(Emergency Ambulatory Care Unit) infusions are organised on an ad-hoc
basis depending on what referrals come into the team. They estimate they
do 2-3 infusions a week with 1 nurse and 1 Doctor. In RAMU (Rapid Access
Medical Unit) the sessions are 3 days a week  with booked times. They are
managed by 2 nurses during these times.
