Please see below the Council’s response to your request for information.

 

1 A signed copy of the negative EIA screening opinion for application

The original was sent out on the 7^th January 2016 and a copy has been
attached to this response.

   

2 A copy of the request from the developer for a screening opinion.

There was  no request from the Developer for an ES screening opinion,
since this is not required under regulation 7 of the 2011 EIA regulations 
[as amended in 2015] i.e. the LPA can issue an opinion irrespective of
whether the applicant requested an opinion or not. [Regulations 5 and 7
refer].   

    

3 A copy of the completed checklist* to support the opinion, and/or
alternative supporting documentation. If not self evident from the
documents please also indicate who prepared/completed them.

The letter sent out by Gary Rayner was prepared by the case officer Mr
Butler, and as is evidenced by the references on the letter, Mr Butler was
clearly aware of the EIA analysis and checklist proforma as the guidance
on EIA in the NPPG is specifically noted in the letter . In addition, it
is evident from paragraphs 1-3 in the letter that the iterative/
sequential  process required by the NPPG was followed by the LPA in
determining that no ES is required for the application. There is no
statutory requirement for the checklist to be physically completed, the
only requirement is that the LPA has had due regard to it, and
consequently, beyond the information contained within the letter, there is
no further recorded information to provide
