(2) As they appear to have been omitted, please could you send me copies of the line items, relating to payments and refunds to/from Serco Ltd re London Cycle Hire Scheme for August 2009 to April 2011. Please could you send these in the same layout as the financial transparency spreadsheets, in CSV or Excel format.

(3) I would also like to see the underlying invoices and credit notes relating to (2), including any attached Service Failure Deduction Calculation Reports or Variable Cost Calculation Reports.

TfL’s expenditure on items over £500, including payments to Serco for
Barclays Cycle Hire.

Your request has been considered under the requirements of the Freedom of
Information Act 2000 and I can confirm that TfL does hold the information
you require. Please find our answers below, headed by your questions.

(1) For each financial period shown (2011 P9-P13), please provide the
total monthly spend for the items that have been withheld.

Please see the table below. There was a higher number of redactions in
Period 9 because we were confirming whether certain items should be
disclosed. This was subsequently resolved; hence the much lower number of
redactions in subsequent periods.

These items are included in the published information on our website,
however for ease of reference we have listed them separately in the
attached spreadsheet.

A list of invoices paid prior to Period 9 2010/11 is also attached which
includes some items from Period 9 to 13 which were in the published
schedule but were separately categorised.

(3) I would also like to see the underlying invoices and credit notes
relating to (2), including any attached Service Failure Deduction
Calculation Reports or Variable Cost Calculation Reports.

Please see the attached PDF for copies of invoices and credit notes.
Please be aware that some payment detail in the invoices has been redacted
while service failure deduction reports and variable cost reports have
been withheld as this information is subject to a section 43 statutory
exemption to the right of access to information.

Section 43 has been applied as disclosure of this information is likely to
prejudice the commercial interests of TfL and/or Serco. Detailing key
financial information from the London Cycle Hire Scheme contract and
Serco’s performance (evidenced by the level of service failure
deductions and variable charge calculations) would allow third parties to
establish the financial and commercial impact or risk to TfL and Serco.

TfL wishes to protect its commercial interests and ability to participate
in future commercial activity. In order to do this, we are withholding key
commercial information which would show the financial position of both
parties. TfL also has a responsibility to protect information that
provides details of Serco’s sources of competitive advantage in winning
the contract, as well as details of Serco’s performance against its
obligations. The disclosure of this information would be to the detriment
of present and future business activities for both parties.

The use of a section 43 exemption is subject to an assessment of the
public interest in relation to the disclosure of the information
concerned. TfL recognises the need for openness and transparency within
Public Authorities and the current strong interest in the scheme. However,
in this instance this is outweighed by the damage that would be done to
TfL in obtaining best value for money in its current and future
negotiations, and the belief that disclosure would be prejudicial to
Serco’s interests by allowing competitors to deduce its performance
against the contract.
